I'll b 5B <br />RESOLUTION NO. 2025 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, DIRECTING THE CITY MANAGER TO INITIATE PUBLIC ENGAGEMENT <br />ACTIVITIES AND DEVELOP A COMPREHENSIVE PLAN OF ACTION UNDER NEW <br />STATE REGULATIONS GOVERNING MOTORIZED SCOOTERS AND ELECTRIC <br />BICYCLES; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, through Ordinance No. 2023-609, the City Commission of Sunny Isles Beach <br />(the "City") established local regulations governing the use and operation of motorized scooters <br />and similar wheeled devices to protect the health, safety, and welfare of all city residents and <br />visitors; and <br />WHEREAS, following an educational implementation period, the City has registered <br />more than 1,008 motorized scooters, issued 2,240 violations, and issued 10 Uniform Traffic <br />Citations for the most egregious behavior; and <br />WHEREAS, the State of Florida enacted Senate Bill 462, now codified as Chapter 2025- <br />149, Laws of Florida, which expands the authority of municipalities to regulate the operation of <br />motorized scooters and electric bicycles; and <br />WHEREAS, while the City's existing regulations have received mixed reactions, the City <br />Commission recognizes the need for broader public input, thorough enforcement research, and <br />budgetary consideration; and <br />WHEREAS, the City seeks to ensure that all regulatory decisions promote the public <br />interest and improve safety on City streets and sidewalks. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA: <br />Section 1. Direction to the City Manager. The City Commission hereby directs the City <br />Manager to organize and facilitate public engagement activities, including but not limited to <br />town hall meetings and surveys to collect public input regarding the regulation of motorized <br />scooters and electric bicycles. The City Manager is further directed to analyze budgetary <br />impacts and enforcement strategies related to the implementation of updated scooter <br />regulations under Chapter 2025-149, Laws of Florida. <br />Section 2. Comprehensive Plan of Action. The City Manager shall develop a viable and <br />comprehensive plan of action to be presented to the City Commission. <br />Section 3.
