RESOLUTION NO. 2025 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN <br />AGREEMENT WITH TEAM CONTRACTING, INC., FOR EMERGENCY REPAIRS TO <br />THE STORM DRAIN LOCATED AT 177TH DRIVE, IN AN AMOUNT NOT TO EXCEED <br />SIXTY-THREE THOUSAND SEVEN HUNDRED EIGHTY-NINE DOLLARS AND FIFTY- <br />NINE CENTS ($63,789.59), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING <br />THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS <br />RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") experienced a collapse of a storm <br />drain structure on 177th Drive, resulting in a sinkhole affecting the roadway and adjacent <br />sidewalk; and <br />WHEREAS, the collapse was determined to be caused by the extremely poor condition <br />of the existing infrastructure, and exploratory work conducted by City staff confirmed that full <br />replacement of the structure is the only viable solution; and <br />WHEREAS, the scope of emergency repair work includes fabrication and installation of a <br />custom -sized storm drain structure, followed by restoration of the roadway, including new <br />asphalt, curb, gutter, and sidewalk (the "Emergency Repairs"); and <br />WHEREAS, to avoid delays in this critical infrastructure repair, the City Manager <br />authorized the issuance of a purchase order to Team Contracting, Inc. (the "Contractor") to <br />perform the Emergency Repairs, in the amount of Fifty -Seven Thousand Nine Hundred Ninety <br />Dollars and No Cents ($57,990.54); and <br />WHEREAS, the City is requesting an additional 10% contingency in the amount of Five <br />Thousand Seven Hundred Ninety -Nine Dollars and Five Cents ($5,799.05) to address any <br />unforeseen conditions that may arise during the course of the repair work; and <br />WHEREAS, the City Commission wishes to authorize the City Manager to negotiate and <br />execute an Agreement with the Contractor for the Emergency Repairs, in an amount not to <br />exceed Sixty -Three Thousand Seven Hundred Eighty -Nine Dollars and Fifty -Nine Cents <br />($63,789.59), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Authority to Negotiate and Execute Agreement. The City Commission hereby <br />authorizes the City Manager to negotiate and execute an Agreement with the Contractor for <br />the Emergency Repairs, in an amount not to exceed Sixty -Three Thousand Seven Hundred <br />Eighty -Nine Dollars and Fifty -Nine Cents ($63,789.59), attached hereto as Exhibit "A". <br />Section 2.
