2. If the Special Magistrate upholds the violation, and the vessel is not removed <br />within the prescribed time ordered, the vessel may be removed, towed and <br />impounded by the City or its contractor to the nearest licensed marine facility, in <br />accordance with this section and applicable law, until such time as the vessel <br />owner or lienholder retrieves the vessel after paying all costs associated with the <br />removal, towing and impoundment, along with all accrued fines owed to the City. <br />3. If no vessel owner timely appeals the Special Magistrate's order(s), or all appeals <br />from the Special Magistrate's order(s) have been exhausted, and the vessel owner <br />or_lienholder has failed to retrieve the vessel from the impoundment facility within <br />ninety (90) days thereof, the City or its contractor may dispose of the vessel in <br />accordance with applicable law. <br />D. Provisions contained herein are supplemental. Nothing contained herein shall prohibit <br />the City from enforcing this Chapter by any other means, including pursuing any other <br />remedies available at law or equitable relief. The enforcement procedures outlined <br />herein and in Chapter 14 are cumulative to all others and shall not be deemed to be <br />prerequisites to filing suit for the enforcement of any section of this Chapter. <br />E. Contractors; License and Insurance Required. A contractor performing removal, towing, <br />or impoundment services pursuant to this Chapter shall: <br />1. be licensed in accordance with United States Coast Guard regulations. as <br />applicable: <br />2. obtain and carry a current insurance policy issued by a licensed insurance carrier <br />in this state to insure against any accident, loss, injury, property damage, or other <br />casualty caused by or resulting from the contractor's actions: and <br />3. be properly equipped to perform such services. <br />Section 3. Repealer. All ordinances, or parts of ordinances in conflict herewith be, and the <br />same, are hereby repealed to the extent of such conflict. <br />Section 4. Severability. If any section, subsection, clause or provision of this Ordinance is <br />declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not <br />be affected by such invalidity but shall remain in full force and effect. <br />Section 5. Inclusion in the Code. It is the intention of the City Commission, and it is hereby <br />ordained that the provisions of this Ordinance shall become and made a part of the Code of <br />Ordinances of the City of Sunny Isles Beach; that the sections of this Ordinance may be <br />renumbered or re -lettered to accomplish such intentions; and that the word "Ordinance" shall <br />be changed to "Section" or other appropriate word, as required. <br />Section 6. Effective Date.
