RESOLUTION NO. 2025 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, WAIVING THE BIDDING REQUIREMENTS SET FORTH IN CHAPTER 62 OF THE CODE OF ORDINANCES APPROVING AN AGREEMENT WITH MILLENIUM PRODUCTS, INC. TO INSTALL SURVEILLANCE AND SECURITY EQUIPMENT AT THE INTRACOASTAL SPORTS PARK, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED EIGHTY-SIX THOUSAND NINE HUNDRED FIFTY-FOUR DOLLARS AND FIFTY-SIX CENTS ($186,954.56), ATTACHED HERETO AS EXHIBIT W; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach (the "City") is in need of a contractor to install surveillance and security equipment (the "Services") at the property located at 16042 Collins Avenue, known as Intracoastal Sports Park ("ISP")• and WHEREAS, a portion of the Services will be purchased utilizing the General Services Administration ("GSA") Contract No. GS-07F-0031W, awarded to Millenium Products, Inc. (the "Vendor"), in an amount not to exceed One Hundred Seventy -Three Thousand Five Hundred Nine Dollars and Sixty -Three Cents ($173,509.63); and WHEREAS, pursuant to the City's procurement code provisions, purchases made through intergovernmental cooperative purchasing arrangements or purchasing consortiums organized as a not -for -profit corporation whose members are governmental entities, provided that such cooperative purchasing arrangements or consortiums provide for a competitive process to select a vendor are exempt from the City's competitive bidding procedures; and WHEREAS, certain items will be purchased through the open market ("Open Market Items"), in an amount not to exceed Thirteen Thousand Four Hundred Forty -Four Dollars and Ninety -Three Cents ($13,444.93); and WHEREAS, pursuant to Section 62-12 of the City's Code of Ordinances ("Code"), "[t]he City Commission may authorize the waiver of competitive bidding procedures upon the recommendation of the City Manager that it is in the City's best interest to do so, to obtain goods and services which cannot be acquired through the normal purchasing process due to insufficient time, the nature of the goods or services, or other factors"; and WHEREAS, after conducting a due diligence review of available resources, the City Manager has determined that it is in the best interest of the City to waive the bidding requirements set forth in Chapter 62 of the City's Code for purchase of the Open Market Items only; and WHEREAS, the Vendor has expressed its ability and desire to provide the Services; and WHEREAS, the City wishes to enter into an Agreement with the Vendor for the Services, in an amount not to exceed One Hundred Eighty -Six Thousand Nine Hundred Fifty -Four Dollars and @BCL@80152D56 Page 1 of 2 160
