RESOLUTION NO.2025 - �q3 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN ART <br />DONATION AGREEMENT WITH JOSEPH MILTON FOR THE SCULPTURE KNOWN <br />AS "MARIPOSAS AZULES" BY MANOLO VALDES; AUTHORIZING THE CITY <br />MANAGER AND CITY ATTORNEY TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, Joseph Milton is the owner of an art sculpture known as "Mariposas Azules" <br />by Manolo Valdes (the "Sculpture"); and <br />WHEREAS, St. Tropez Beach Developers LLC (the "Owners"), are the owners of the <br />property located at 16690 Collins Avenue (the "Property"); and <br />WHEREAS, the Sculpture is currently located on the northeast corner of the Property; <br />and <br />WHEREAS, Joseph Milton has approached the City of Sunny Isles Beach (the "City") with <br />an offer to donate the Sculpture; and <br />WHEREAS, the Sculpture was the required Art in Public Places component of the <br />Owners development project approved in 2019 by Resolution No. 2019-3009; and <br />WHEREAS, the Sculpture is substantial in size, requires ongoing maintenance, and is <br />located on private property; and <br />WHEREAS, these and other factors, including but not limited to, liability, insurance, and <br />licensing, must be negotiated and agreed to with Joseph Milton and the Owner if it is the desire <br />of the City Commission to accept the donation; and <br />WHEREAS, the City Commission wishes to authorize the City Manager to negotiate the <br />terms of a proposed donation agreement with Joseph Milton and the Owner and present the <br />final proposed agreement for approval by the City Commission. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Authorization of City Manager. The City Manager is hereby authorized to <br />negotiate the terms of a donation agreement and present the final agreement for approval by <br />the City Commission. <br />Section 2. Effective Date.
