Oq SUNNY I SIPO AGREEMENT BETWEEN THE CITY OF SUNNY ISLES BEACH AND AUM CONSTRUCTION, INC. CONTRACT NO.2025-7579 TIJJS CONTRACTUAL AGREEMENT (hereinafter "Agreement") is made this 10 day of 4%r 2025, by and between the CITY OF SUNNY ISLES BEACH, Florida, (hereinafter "City"), and AUM CONSTRUCTION, INC., a Florida corporation, whose Federal Employer Identification (FEI) No. is 20-8608887 (hereinafter "Contractor"). RECITALS WHEREAS, the City is in need of a contractor to construct and bring the temporary dual left turn at 183`d Street and Collins Avenue into compliance with Miami -Dade County and Florida Department of Transportation (FDOT) requirements, as more particularly described in Invitation to Bid ("ITB") No. 25-09-01, entitled "183`d Street and Collins Avenue Left Turn Conversion," which is appended hereto as Attachment "A," and incorporated herein by reference and made a part hereof (hereinafter "Services," "Work," or "Project"); and WHEREAS, upon evaluation, Contractor was determined to have submitted the lowest and most responsible and responsive bid; and WHEREAS, Contractor is qualified, willing and able to provide the Services subject to the terms and conditions contained herein; and WHEREAS, the City wishes to contract with Contractor to complete the Work as more particularly described in the Contract Documents for Ninety -Nine Thousand Five Hundred Dollars and No Cents ($99,500.00), and a contingency amount, if necessary, of Nine Thousand Nine Hundred Fifty Dollars and No Cents ($9,950.00), for a total not -to -exceed amount of One Hundred and Nine Thousand Four Hundred Fifty Dollars and No Cents ($109,450.00); NOW THEREFORE, in consideration of the promises and the mutual covenants set forth herein, the Parties agree as follows: ARTICLE I THE CONTRACT AND THE CONTRACT DOCUMENTS 1.1 The Contract 1.1.1 The Contract between the City and the Contractor, of which this Contract is a part, consists of the Contract Documents. It shall be effective on the date this Contract is executed by the last party to execute it. 1.2 The Contract Documents 1.2.1 The Contract Documents consist of this Contract, the Bid Documents (Invitation to Bid No. 25-09-01, the "ITB"), the Specifications, the Drawings, the Plans, addenda to the ITB, Contractor's Response to ITB, all of which are attached hereto as Attachment "A" and incorporated herein by reference, as well as any Addenda, any Supplemental Conditions, all Change Orders and Field Orders issued hereinafter, any other amendments hereto executed by the parties hereafter, together with the following (if any): AUM CONSTRUCTION, INC.
