Any coverage maintained by the City shall apply excess of, or contingent upon the <br />absence of, other insurance required or maintained by Contractor. All insurance policies and <br />bonds required by this Contract shall be issued by an insurance company, acceptable to the <br />City and authorized to do business in the State of Florida with an A.M...Best rating of B+ or <br />better. <br />13.2 Comprehensive General Liability. Contractor agrees to maintain General <br />Liability at a limit of liability not less than $1,000,000 Each Occurrence $2,000,000 Annual <br />Aggregate on a primary and non-contributory basis, including the City of Sunny Isles Beach <br />as an Additional Insured. Coverage must be offered in a form no more restrictive than the <br />latest edition of the Comprehensive General Liability policy, without restrictive <br />endorsements, as filed by the Insurance Services Office, and shall specifically include the <br />following with minimum limits not less than those required for Bodily Injury Liability <br />and Property Damage Liability: <br />• Premises and Operation; <br />• Independent Contractors; <br />• Products and/or Completed Operations Hazard; <br />• Broad Form Property Darnage <br />• Broad Form Contractual Coverage applicable to this Contract, including any <br />hold harmless and/or Indemnification Agreement; <br />• Personal Injury Coverage with Employee and Contractual Exclusions removed, <br />with minimum limits of coverage equal to those required for Bodily <br />Injury Liability and Property Damage Liability; <br />13.3 Business Automobile Liability. Contractor agrees to maintain Business <br />Automobile Liability at a limit of liability not less than $1,000,000 per Occurrence combined <br />single limit for Bodily Injury Liability and Property Damage Liability. Coverage must be afforded <br />o n a form no more restrictive than the latest edition of the Business Automobile Liability policy, <br />without restrictive endorsements, as filed by the Insurance Services Office, and must include: <br />Owned, Non -Owned & Hired automobiles, and Employers' Non -City ship. <br />13.4 Worker's Compensation & Employer's Liability. Contractor agrees to maintain <br />Worker's Compensation & Employers Liability Insurance in accordance with Florida Statutes, <br />including Employer's Liability, of $1,000,000. <br />13.5 Builder's Risk Insurance. Coverage shall be "All Risk" coverage for one hundred <br />percent (1001/1o) of the completed value of the structure(s), building(s) or a.ddition(s). Where the <br />contract calls for install of machinery or equipment, the policy must be endorsed to provide <br />coverage on "All Risk" basis during transit and installation. The policy must be issued with a <br />deductible of not more than $50,000 per claim. <br />13.6 Waiver of Subrogation. Contractor agrees by entering into this written Contract to a <br />Waiver of Subrogation in favor of the City, Contractor, Sub -Contractors, Architects, or Engineer <br />for each required policy providing coverage during the life of this Contract. When required by <br />the insurer, or should a policy condition not permit the Contractor to enter into a pre -loss Contract <br />to waive subrogation without an endorsement, the Contractor agrees to notify the insurer and <br />AUM CONSTRUCTION, INC. 33 <br />
