°SVNNY /5 <br />y <br />u j x <br />CONSTRUCTION CONTRACT BETWEEN THE CITY OF <br />SUNNY ISLES BEACH AND YC GROUP, LLC <br />CONTRACT NO. 2025-9138 <br />THIS CONTRACT is made and entered into this day of 2025, by <br />and between CITY OF SUNNY ISLES BEACH, a municipal corporation of the State of Florida, <br />whose address is 18070 Collins Avenue sunny Isles Beach, Florida 33160 (hereinafter "City") <br />and YC Group, LLC., a Florida limited liability company, whose Federal Employer Identification <br />(FEI) No. is 84-3001434 (hereinafter "Contractor"). The City and the Contractor hereby agree as <br />follows: <br />WHEREAS, the City is in need of a Contractor to construct the replacement of <br />approximately 192 linear feet of seawall along Bella Vista Park, located at 500 Sunny Isles <br />Boulevard, as more particularly described in Invitation to Bid (ITB) No. 25-04-01, entitled <br />"Bella Vista Seawall Replacement," issued on April 2, 2025, which is attached hereto as Exhibit <br />"A," and incorporated herein by reference and made a part hereof (hereinafter "Project" or <br />"Work"); and <br />WHEREAS, upon evaluation, Contractor was determined to have submitted the <br />lowest responsible and responsive bid; and ' <br />WHEREAS, Contractor is qualified, willing and able to provide and complete the <br />Work subject to the terms and conditions contained herein; and <br />WHEREAS, the City wishes to contract with Contractor to provide and complete the Work <br />for Nine Hundred Ninety -Five Thousand Two Hundred Thirty -Two Dollars and Thirty -One <br />Cents ($995,23241), plus Ninety -Nine- Thousand Five Hundred Twenty -Three Dollars and <br />Twenty -Three Cents ($99,523.23) for contingency, if necessary, resulting in a total not -to -exceed <br />amount of One Million Ninety -Four Thousand Seven Hundred Fifty -Five Dollars and <br />Fifty-FoNiOWETR9I$EMEt,76160jderation of the mutual covenants contained in this Agreement <br />and other good and valuable consideration, the adequacy and receipt of which are hereby <br />acknowledged, the Parties agree as follows: <br />ARTICLE I <br />THE CONTRACT AND THE CONTRACT DOCUMENTS <br />1.1 The Contract <br />1.1.1. The Contract between the City and the Contractor, of which this Contract is a part, <br />consists of the Contract Documents.
