RESOLUTION NO.2026 -
<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
<br />FLORIDA, CORRECTING A SCRIVENER'S ERROR IN RESOLUTION NO. 2025-3782
<br />TO REFLECT THE CORRECT NOT -TO -EXCEED AMOUNT OF THREE MILLION EIGHT
<br />HUNDRED THIRTY-FOUR THOUSAND FIVE HUNDRED THREE DOLLARS AND NO
<br />CENTS ($3,834,503.00) FOR PAYMENT OF THE INSURANCE PREMIUMS FOR
<br />EMPLOYEE HEALTH INSURANCE, DENTAL INSURANCE, VISION CARE, LIFE
<br />INSURANCE, ACCIDENTAL, DEATH & DISMEMBERMENT (AD&D) INSURANCE,
<br />AND LONG TERM DISABILITY INSURANCE; AUTHORIZING THE CITY MANAGER
<br />TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING
<br />FOR AN EFFECTIVE DATE.
<br />WHEREAS, on January 161h, 2025, via Resolution No. 2025-3782, the City Commission of
<br />the City of Sunny Isles Beach ("City") approved the selection of United Healthcare as the
<br />provider of employee health and dental insurance, EyeMed as the provider of vision care, and
<br />Mutual of Omaha as the provider of life insurance, accidental, death & dismemberment
<br />("AD&D") insurance, and long term disability insurance, in an amount not to exceed
<br />$3,353,024.00; and
<br />WHEREAS, Resolution No. 2025-3782 contained a Scrivener's Error incorrectly
<br />referencing a total Not -to -Exceed contract amount of $3,353,024.00 ("Incorrect NTE"); and
<br />WHEREAS, the Incorrect NTE reflected only the total for employee health insurance; and
<br />WHEREAS, Resolution No. 2025-3782 approved the premium amounts for dental
<br />insurance as $159,568, vision care as $20,456, and life insurance, AD&D insurance, and long
<br />term disability insurance as $101,455.00
<br />WHEREAS, Resolution No. 2025-3782 also included approval for the allocation of
<br />$200,000.00 as contingency, if necessary; and
<br />WHEREAS, the City Commission wishes to correct the Scrivener's Error in Resolution No.
<br />2025-3782 to accurately reflect the total not to exceed amount of Three Million Eight Hundred
<br />Thirty -Four Thousand Five Hundred Three Dollars and No Cents ($3,834,503.00); and
<br />WHEREAS, this correction is justified on the following grounds: (i) correction is essential
<br />to ensure the intent of the Commission; (ii) correction does not include a change of judgment
<br />or prior intent of the Commission; and (iii) the record, including but not limited to the staff
<br />report, minutes and motion, evidences the clear intent of the Commission.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
<br />ISLES BEACH, FLORIDA, AS FOLLOWS:
<br />Section 1. Correction of Scrivener's Error. The City Commission hereby approves the
<br />correction of a Scrivener's Error contained in Resolution No. 2025-3782 to accurately reflect the
<br />total not to exceed amount of Three Million Eight Hundred Thirty -Four Thousand Five Hundred
