RESOLUTION NO. 2026 - ` n A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, EXPRESSING OPPOSITION TO FLORIDA HOUSE BILL 145 AND FLORIDA SENATE BILL 1366, RELATING TO CLAIMS AND SUITS AGAINST THE GOVERNMENT; DIRECTING THE CITY CLERK TO TRANSMIT COPIES OF THIS RESOLUTION; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Florida House Bill 145 and Florida Senate Bill 1366 (collectively, the "Proposed Legislation") propose significant changes to Section 768.28, Florida Statutes, relating to claims and suits against the government, including substantial increases to statutory limits on governmental liability for tort claims; and WHEREAS, the proposed legislation would expose municipalities to increased financial risk, higher insurance premiums, and greater litigation costs, thereby adversely impacting municipal budgets and the ability of local governments to deliver essential services; and WHEREAS, the City Commission finds that it is in the best interest of its residents to oppose the Proposed Legislation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expression of Opposition. The City Commission hereby expresses its opposition to the Proposed Legislation. Section 2. Direction to the City Clerk. The City Clerk is hereby directed to transmit copies of this Resolution to the Florida League of Cities, the President of the Florida Senate, the Speaker of the Florida House, of Representatives, and the Governor of the State of Florida. Section 3. Authorization of the City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date.
