RESOLUTION NO. 2026 - ` n <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES <br />BEACH, FLORIDA, EXPRESSING OPPOSITION TO FLORIDA HOUSE BILL 145 <br />AND FLORIDA SENATE BILL 1366, RELATING TO CLAIMS AND SUITS <br />AGAINST THE GOVERNMENT; DIRECTING THE CITY CLERK TO TRANSMIT <br />COPIES OF THIS RESOLUTION; AUTHORIZING THE CITY MANAGER TO DO <br />ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING <br />FOR AN EFFECTIVE DATE. <br />WHEREAS, Florida House Bill 145 and Florida Senate Bill 1366 (collectively, the <br />"Proposed Legislation") propose significant changes to Section 768.28, Florida Statutes, <br />relating to claims and suits against the government, including substantial increases to <br />statutory limits on governmental liability for tort claims; and <br />WHEREAS, the proposed legislation would expose municipalities to increased <br />financial risk, higher insurance premiums, and greater litigation costs, thereby adversely <br />impacting municipal budgets and the ability of local governments to deliver essential <br />services; and <br />WHEREAS, the City Commission finds that it is in the best interest of its residents <br />to oppose the Proposed Legislation. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF <br />SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expression of Opposition. The City Commission hereby expresses its <br />opposition to the Proposed Legislation. <br />Section 2. Direction to the City Clerk. The City Clerk is hereby directed to transmit <br />copies of this Resolution to the Florida League of Cities, the President of the Florida <br />Senate, the Speaker of the Florida House, of Representatives, and the Governor of the <br />State of Florida. <br />Section 3. Authorization of the City Manager. The City Manager is hereby authorized <br />to do all things necessary to effectuate this Resolution. <br />Section 4. Effective Date.
