<br />CITY OF SUNNY ISLES BEACH AND EXQUISITE
<br />CATERING BY ROBERT, INC.

<br />THIS SECOND AMENDMENT TO THE AGREEMENT between the CITY OF
<br />SUNNY ISLES BEACH (hereinafter "City") and EXQUISITE CATERING BY ROBERT,
<br />INC., a Florida corporation, whose Federal Employer Identification (FEI) Number is 20-8356568
<br />(hereinafter "Contractor"), executed this 44 day of 1090y 2026, is made a part of the original
<br />Agreement between the City and Contractor, dated April 25, 2024, as amended on March 25, 2025
<br />(hereinafter collectively "the Agreement"), attached hereto as Exhibit "A." The City and
<br />Contractor hereby agree as follows:
<br />1. THE CONTRACT DOCUMENTS. City and Contractor wish to amend Section 2 of the
<br />Agreement, entitled "The Contract Documents," by adding Contractor's 2025-2026 Proposal for
<br />the City's Anniversary event on February 28, 2026, which is appended hereto as Exhibit "B."
<br />2. SERVICES. City and Contractor wish to amend Section 3 of the Agreement, entitled
<br />"Services," as follows:
<br />Contractor agrees to provide the Services as more particularly set forth in the Contract
<br />Documents. All deliverables as per the Contract Documents shall be delivered, installed,
<br />and event ready at Samson Oceanfront Park, 17425 Collins Avenue, at least two (2) hours
<br />prior to 6:00 pm on the day of event, February 28, 2026, and must be removed within two
<br />(2) hours after the end of the event, which is scheduled at 10:00 pm.
<br />3. ADDITIONAL COMPENSATION. City and Contractor wish to amend Section 5 of the
<br />Agreement, entitled "Compensation," to provide additional compensation for the Services and
<br />rates more particularly described in Exhibit "B," in an amount not to exceed Eighty -Four Thousand
<br />One Hundred Twenty -Eight Dollars and No Cents ($84,128.00). The additional compensation
<br />provided herein will bring the total Agreement to a not -to -exceed amount of Two Hundred Forty -
<br />Two Thousand Six Hundred Seventy -Two Dollars and Sixty Cents ($242,672.60).
<br />4. INSURANCE. City and Contractor wish to amend Section 10 of the Agreement, entitled
<br />"Insurance," to include the following additional coverage:
<br />E. Liquor liability insurance policy, in standard form, insuring Contractor, and City as
<br />an additional insured on a primary and non-contributory status in favor of City,
<br />against any and all liability for bodily injury or property damage arising directly or
<br />indirectly from the sale or dispensing of alcoholic beverages, with a policy limit of
<br />not less than One Million Dollars ($1,000,000.00) general aggregate.
<br />5. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein,
<br />all terms and conditions of the original Agreement between the parties, dated April 25, 2024, as
<br />amended, shall remain in full force and effect.
<br />6. CONFLICTING PROVISIONS. The terms, statements, requirements, or provisions
<br />contained in this Second Amendment shall prevail and be given superior effect and priority over
<br />any conflicting or inconsistent terms, statements, requirements, or provisions contained in any
<br />other document or attachment, including but not limited to Exhibits "A" and "B."
