122112014 Item Cwersheet <br />executing a binding Proportionate Share Mitigation Agreement (the <br />"Agreement ") between the School Board, PMG -S2 Sunny Isles, LLC <br />(the "Applicant') and the City requiring the Applicant to provide <br />mitigation funds for public school facilities created by the Project and <br />requiring the City to withhold all building permits until the mitigation <br />payments have been made by the Applicant. Staff is requesting <br />approval of the Agreement subject to continuing negotiations to <br />ensure that the funds are allocated to school projects in the City. As <br />presently drafted, Section 4 of the Agreement ( "monetary <br />proportionate share mitigation ") indicates "It is the intent of the School <br />District to locate the School Project within the City proper." This <br />language is too broad.
