February 19, 2026 <br />PZ2025-15 <br />The proposed variance meets some, but not all, of the above criteria. The proposed <br />structure is temporary and significantly smaller in size than what is permissible in this <br />zoning district, which is a special circumstance not applicable to other structures or <br />buildings in the same zoning district. However, literal interpretation and application of the <br />setbacks does not deprive the Applicant of rights commonly enjoyed by other properties, <br />as the property is a rectangular shaped lot of ample size to accommodate a structure. <br />Granting the variance is not injurious to the neighborhood, or otherwise detrimental to the <br />public safety and welfare and will not substantially diminish or impair property values <br />within the vicinity. <br />VII. FINAL ANALYSIS <br />Conditional and Temporary Use <br />The proposed temporary off -site sales center is consistent with the City's Comprehensive <br />Plan and Land Development Regulations, specifically the review criteria for conditional <br />uses and temporary uses. <br />Variance <br />The requested variance to reduce the north side setback from 20' to 11' complies with <br />some, but not all of the Land Development Regulations, specifically Sections §265-15.G, <br />which outlines the review standards for variance applications. Literal interpretation of the <br />development and sign standards would not deprive the Applicant of rights commonly <br />enjoyed by other properties and are not essential to enable reasonable use of the land, <br />as a sales center can reasonably be constructed without them. However, granting the <br />variances would not harm the neighborhood, negatively impact public safety or welfare, <br />or significantly diminish or impair property values in the surrounding area. <br />Site Plan <br />The proposed site plan application is consistent with the City's Comprehensive Plan and <br />Land Development Regulations, with the exception of the requested north side setback <br />variance. The request for graphics on the temporary construction fence is reasonable, as <br />the development projects along Collins Avenue have commonly utilized graphics on the <br />fencing. <br />Staff has compiled the relevant facts of the requested conditional use, temporary use, <br />variances, and site plan approval and recommends that the application is presented to <br />City Commission for consideration. <br />Vill.
