RESOLUTION NO. 2026-� <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING AN AGREEMENT WITH SHIFF CONSTRUCTION & <br />DEVELOPMENT, INC. FOR THE GATEWAY PEDESTRIAN BRIDGE ELEVATOR <br />ENCLOSURES PROJECT, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED <br />THIRTY-EIGHT THOUSAND SIX HUNDRED TWENTY-FIVE DOLLARS AND NO <br />CENTS ($238,625.00); AUTHORIZING THE MAYOR TO EXECUTE SAID <br />AGREEMENT; AUTHORIZING THE CITY MANAGER TO ADMINISTER THE <br />AGREEMENT AND APPROVE A PROJECT CONTINGENCY; PROVIDING FOR AN <br />EFFECTIVE DATE. <br />WHEREAS, the City of Sunny Isles Beach (the "City") is in need of a contractor to make <br />improvements at the Gateway Pedestrian Bridge to enclose the elevator areas (the "Project"); <br />and <br />WHEREAS, the City utilized the Broward County pre -qualified contractors list to solicit <br />quotes for the Project, and an Invitation to Quote ("ITQ") and mandatory site visit was <br />distributed to thirteen (13) contractors from the pre -qualified list; and <br />WHEREAS, Section 62-13(C) of the City's Code of Ordinances provides that purchases <br />made under state general service administration contracts, federal, county or other <br />governmental contracts or competitive bids with other governmental agencies are exempt from <br />the bidding requirements set forth in Chapter 62; and <br />WHEREAS, Shiff Construction & Development, Inc. (the "Contractor") was one of the <br />two (2) contractors who submitted quotes in response to the ITQ; and <br />WHEREAS, the Contractor submitted the lowest responsive and responsible quote; and <br />WHEREAS, the City Commission wishes to approve an Agreement with the Contractor <br />for the Project, in an amount not to exceed Two Hundred Thirty -Eight Thousand Six Hundred <br />Twenty -Five Dollars and No Cents ($238,625.00), which includes a contingency, if necessary, in <br />an amount not to exceed Thirty -One Thousand One Hundred Twenty -Five Dollars and No Cents <br />($31,125.00), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of Agreement. The City Commission hereby approves an Agreement <br />with the Contractor for the Project, in an amount not to exceed Two Hundred Thirty -Eight <br />Thousand Six Hundred Twenty -Five Dollars and No Cents ($238,625.00), which includes a <br />contingency, if necessary, in an amount not to exceed Thirty -One Thousand One Hundred <br />Twenty -Five Dollars and No Cents ($31,125.00), attached hereto as Exhibit "A". <br />@BCL@B014A248 Page 1 of 2 <br />238 <br />
