of the construction, maintenance, repair, renovation, remodeling, or improvement of a building, <br />road, street, sewer, storm drain, water system, site development, irrigation system, reclamation <br />project, gas or electrical distribution system, gas or electrical substation, or other facility, project, <br />or portion thereof owned in whole or in part by any governmental entity." To the extent any Work <br />or Services provided for in this Agreement constitutes a public works project, as defined in Section <br />255.0993, Florida Statutes, subject to the exclusions contained therein, any iron or steel product <br />permanently incorporated in the Work or Services must be produced in the United States. <br />15.2 Criminal Background Checks <br />15.2.1 Contractor herein certifies and attests under penalty of perjury that prior to <br />performing the Work pursuant to the Agreement, all managers and employees of Contractor, any <br />independent contractors, and any subcontractors (collectively "Personnel") have undergone a <br />criminal background check consisting of a Florida Department of Law Enforcement ("FDLE") and <br />Florida Crime Information Center/National Crime Information Center ("FCIC/NCIC") criminal <br />records check. Any Personnel not meeting this requirement will not be permitted to perform any <br />Work under this Agreement. Failure of Contractor to comply with this section shall be cause for <br />termination of the Agreement. <br />15.3 Notice <br />15.3.1. In order for a notice to a party to be effective under this Contract, notice must be <br />sent via U.S. certified mail, overnight delivery, or hand delivery to the addresses listed below and <br />shall be effective upon mailing if sent by certified mail or overnight delivery and effective upon <br />receipt if hand delivered.
