p r fLp4t S <br />TO: <br />FROM: <br />DATE: <br />RE: <br />City of Sunny Isles Beach <br />18070 Collins Avenue <br />Sunny Isles Beach, Florida 33160 <br />(305) 947-0606 City Hall <br />(305) 949-3113 Fax <br />MEMORANDUM <br />Honorable Mayor and City Commissioners <br />Fabiola Stuyvesant, Commissioner <br />March 19, 2026 <br />Resolution Directing the Drafting of an Ordinance to Eliminate the <br />Discriminatory "Upland Property Owner" Beach Event Requirement for <br />Residents <br />RECOMMENDATION: <br />This resolution is presented for your consideration. <br />REASONS: <br />Adoption of this Resolution directs the City Manager and the City Attorney to draft a municipal <br />Ordinance within thirty (30) days that abolishes the current Code requirement forcing residents to <br />obtain an "upland property owner" sponsor to host an event on the public beach. The drafted <br />Ordinance shall ensure that all residents of Sunny Isles Beach have equal, direct access to apply for <br />public beach event permits, regardless of which side of Collins Avenue they reside on. <br />The beaches of Sunny Isles Beach are a public asset, maintained and protected by the tax dollars of <br />every single resident in this City. <br />However, under the City's current Special Event permitting procedure, event permits for the public <br />beach are not issued directly to individuals. Any resident seeking to host a simple gathering —such as a <br />family birthday party on the sand —is legally required to have an "upland property owner" (specifically, <br />an oceanfront condominium or hotel) co-sign, sponsor, or approve their application. <br />This bureaucratic requirement creates a discriminatory, two -tiered system of residency. It effectively <br />bans every single resident living on the West side of Collins Avenue from utilizing their own public beach <br />for private family events, simply because they do not own oceanfront real estate. It grants oceanfront <br />condominium boards the arbitrary power to act as gatekeepers over public land. <br />Item Number: 9.0 <br />418 <br />
