RESOLUTION NO. 2026 - <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FIRST AMENDMENT TO THE AGREEMENT WITH MBR <br />CONSTRUCTION, INC. TO PROVIDE ADDITIONAL TIME FOR FINAL COMPLETION <br />OF CONSTRUCTION SERVICES FOR THE INTRACOASTAL SPORTS PARK, AND FOR <br />ADDITIONAL COMPENSATION IN AN AMOUNT NOT TO EXCEED TWO HUNDRED <br />THOUSAND DOLLARS AND NO CENTS ($200,000.00), ATTACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT; <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, on October 22, 2024, via Resolution No. 2024-3732, the City Commission of <br />the City of Sunny Isles Beach (the "City") awarded Invitation to Bid No. 24-07-02 to, and <br />approved an agreement with MBR Construction, Inc. (the "Contractor") to provide construction <br />services for the Intracoastal Sports Park project (the "Services"), in an amount not to exceed <br />$3,517,539.04; and <br />WHEREAS, during the course of the project, additional scope of work has been <br />identified and added to the Services, including conduit installation for CCTV cameras, <br />installation of exercise equipment, additional extensions of sidewalks, lime rock subgrade <br />underneath the walking path, additional conduit for an entry sign to be installed, retaining walls <br />for subgrade support at two seawall locations, and abandonment of a water connection on <br />Collins Avenue ("Additional Services"); and <br />WHEREAS, the Contractor has submitted a proposal to provide the Additional Services, <br />and requests an extension of an additional 132 calendar days for final completion ("Time <br />Extension"); and <br />WHEREAS, the City Commission wishes to approve a First Amendment to the <br />Agreement with the Contractor for the Additional Services and the Time Extension, in an. <br />amount not to exceed Two Hundred Thousand Dollars and No Cents ($200,000.00), bringing the <br />total contract amount not to exceed Three Million Seven Hundred Seventeen Thousand Five <br />Hundred Thirty -Nine Dollars and Four Cents ($3,717,539.04), attached here to as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval of Second Amendment. The City Commission hereby approves the First <br />Amendment to the Agreement with the Contractor for the Additional Services and Time <br />Extension, in an amount not to exceed Two Hundred Thousand Dollars and No Cents <br />($200,000.00), bringing the total contract amount not to exceed Three Million Seven Hundred <br />Seventeen Thousand Five Hundred Thirty -Nine Dollars and Four Cents ($3,717,539.04), attached <br />here to as Exhibit "A". <br />Section 2.
