SUNNY I, , 1 <br />°` eFIRST AMENDMENT TO THE AGREEMENT BETWEEN THE CITY OF <br />SUNNY ISLES BEACH AND TEAM CONTRACTING INC. <br />FLp0.,a�, CONTRACT NO.2024-6780-2 <br />THIS FIRST AMENDMENT TO THE AGREEMENT between the CITY OF SUNNY <br />ISLES BEACH (hereinafter "City") and TEAM CONTRACTING, INC., whose Federak <br />Employer Identification (FEI) No. is 65-1002254 (hereinafter "Contractor"), executed this c,7LS <br />day of September 2025, is made a part of the original Agreement between the City and the <br />Contractor, dated September 4, 2024, attached hereto as Exhibit "l" and incorporated herein by <br />reference. The City and Contractor hereby agree as follows: <br />1. SERVICES. City and Contractor wish to amend Section 3 of the Agreement, entitled <br />"Services," to add the following Services and amend the payment schedule: <br />Excavation, foundation, utilities, roof and wall insulation, as well as the installation of <br />gutters and downspouts, as more particularly described in Composite Exhibit 2 to this First <br />Amendment. <br />2. COMPENSATION. City and Contractor wish to amend Sectiion 5 of the Agreement, <br />entitled "Compensation," to provide additional compensation in an amount not to exceed One <br />Hundred Thirty -Five Thousand Two Hundred Ninety -Four Dollars and Eighteen. Cents <br />($135,294.18). The additional compensation provided herein will bring the total Agreement not to <br />exceed amount to Four Hundred Twenty -Five Thousand Two Hundred Ninety -Four Dollars and <br />Eighteen Cents ($425,294.18), which includes an amount of Twenty -Eight Thousand Twenty - <br />Nine Dollars and Fifty -Four Cents ($28,029.54) for contingency, if necessary, subject to the <br />following revised Payment Schedule: <br />Emma <br />B. Payment Schedule. Payment to Contractor of the sum set forth herein shall be <br />allocated based upon the following: <br />Execution of Agreement .............................................. $39,295.57 <br />Delivery of Building..................................................$157,182.27 <br />Piles, Slab, Building Erected........................................$100,000.00 <br />Final Completion.....................................................$128,816.34 <br />Retainage of five percent (50/6) will be deducted from each payment, to be paid at <br />final completion, subject to the terms of the Agreement. <br />3. OTHER PROVISIONS REMAIN IN EFFECT. Except as specifically modified herein, <br />all terms and conditions of the original Agreement shall remain in full force and effect. <br />4. CONFLICTING PROVISIONS. The terms, statements, requirements, or provisions <br />contained in this First Amendment shall prevail and be given superior effect and priority over any <br />conflicting or inconsistent terms, statements, requirements or provisions contained in any other <br />document or attachment, including but not limited to Exhibits "1" and "2." <br />IN WITNESS WHEREOF, the parties hereto have executed this document as of the date <br />mentioned above. <br />1 LAM CONTRACTING, INC. — FIRST AMENDMENT Page 1 of 4 <br />
