  <br />Exceptions  <br />MCL is committed to providing the City of Sunny Isles Beach with a highly responsive, professionally  <br />managed, and operationally reliable holiday lighting and décor program and welcomes the performance  <br />expectations, maintenance standards, and accountability measures outlined within the solicitation. MCL’s  <br />operational structure, proactive monitoring systems, preventative maintenance procedures, and regional  <br />service presence are specifically designed to support consistent system performance and rapid issue  <br />resolution throughout the holiday season.  <br />Notwithstanding the foregoing, MCL respectfully requests that any performance-related obligations,  <br />response requirements, liquidated damages provisions, or operational timelines be reasonably subject to  <br />standard force majeure considerations and other events outside of MCL’s reasonable control. Such  <br />events may include, but are not limited to, hurricanes, tropical storms, flooding, utility outages, failures  <br />associated with third-party electrical infrastructure, vandalism, vehicular damage, governmental  <br />restrictions, acts of God, unforeseen site conditions, delays associated with required approvals or access  <br />restrictions from the City, and other circumstances beyond the reasonable operational control of the  <br />Contractor.  <br />MCL remains fully committed to working collaboratively with the City to promptly address any such  <br />conditions should they arise and to minimize operational disruptions whenever reasonably possible.  <br />  <br />South Florida Lighting Team, LLC DBA Miami Christmas Lights.  <br /> 71
