RESOLUTION NO. 2015-23(o s <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF <br /> POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME <br /> CONTROL ACT OF 1984, AND IN ACCORDANCE WITH SECTION <br /> 932.7055,F.S.,TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE <br /> DEPARTMENT OF JUSTICE (DOJ)TO PURCHASE NON-BUDGETED <br /> SPECIAL SERVICE POLICE VEHICLES AND ASSOCIATED <br /> EQUIPMENT AND MARKINGS LISTED ON THE ATTACHED <br /> CERTIFICATION,IN AN AMOUNT NOT TO EXCEED ONE HUNDRED <br /> FORTY THOUSAND ONE HUNDRED SEVENTY-SIX DOLLARS AND <br /> SIXTEEN CENTS ($140,176.16); PROVIDING FOR AN EFFECTIVE <br /> DATE. <br /> WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City <br /> and its Police Department are authorized to expend forfeiture funds from the established Department <br /> of Justice (DOJ) federal forfeiture account, for the approved programs or purchases intended to <br /> enhance law enforcement purposes; and <br /> WHEREAS, in accordance with Florida Statutes §932.7055(4)(c)(3) specifically, a law <br /> enforcement agency that acquires at least$15,000.00 pursuant to the Florida Contraband Forfeiture <br /> Act within a fiscal year must expend or donate no less than 15%of such proceeds for the support or <br /> operation of any drug treatment, drug abuse education, drug prevention, crime prevention, safe <br /> neighborhood, school resource officer programs or for other law enforcement purposes; and <br /> WHEREAS,in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br /> Statutes §932.7055(4)(b) upon the request of the Chief of Police to the governing body of a <br /> municipality,liens and forfeiture funds may be expended if accompanied by written certification that <br /> the request complies with the provisions of the aforementioned subsections; and <br /> WHEREAS,the Chief of Police has submitted a request for the purchase of non-budgeted <br /> Special Service Police Vehicles and Associated Equipment and Markings listed on the attached <br /> Certification, in an amount up to One Hundred Forty Thousand One Hundred Seventy-Six Dollars <br /> and Sixteen Cents($140,176.16) in forfeiture(DOJ) funds in compliance with the aforementioned <br /> legal requirements. <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br /> CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, <br /> the Chief of Police is hereby authorized to spend up to One Hundred Forty Thousand One Hundred <br /> Seventy-Six Dollars and Sixteen Cents ($140,176.16) from the established Department of Justice <br /> (DOJ)federal forfeitures account for the purchase of Special Service Police Vehicles and Associated <br /> Equipment and Markings. <br /> R2015-Police Forfeiture(DOJ)Expend Funds Vehicles Page 1 of 2 <br />
