BA also has not been the <br />subject of any criminal litigation during the past five (5) years. <br />BA’s civil litigation history during the past five (5) years consists of the following <br />matter: SH Owner, LLC v. Bermello Ajamil & Partners, Inc., et al., Case No. 2026- <br />008037-CA-01. This lawsuit alleges that the project design included a stairwell <br />that reduced rentable space and that an elevation interpretation issue resulted in <br />the building being classified as a high-rise structure, leading to additional project <br />costs. The matter is currently under evaluation. BA disputes the allegations, believes <br />the claims are without merit, and expects the matter to be resolved favorably.
