E X C E P T I O N S Exceptions to RFQ Terms & Conditions Dempsey Design takes no exceptions to the terms and conditions of RFQ # 26-07-01, as amended by Addenda #1 through #8. Eric Dempsey Architect, LLC (d/b/a Dempsey Design) accepts the Instructions to Proposers and General Terms and Conditions (Section 1), the Special Terms and Conditions (Section 2), the Scope of Work and Technical Specifications (Section 3), and the Bid Submittal requirements (Section 6) as issued and as revised by addenda — including the indemnification language substituted by Addendum # 4 in accordance with §725.08, Florida Statutes, and the liquidated damages provision added by Addendum # 8. This statement is consistent with Item 7 of the Questionnaire at RFQ page 40, submitted in Section 6 of this proposal. I N SURA N C E — CONF IRM AT I ON OF COVERAGE Per Addendum # 4 (A18 and A27), the City will consider firms carrying a minimum Professional Liability limit of $5,000,000, and umbrella or excess coverage is acceptable to reach the required limit provided the excess policy schedules the professional liability policy as underlying and is follow-form. Dempsey Design will maintain Professional Liability, Commercial General Liability, Business Automobile Liability, and Workers’ Compensation / Employer’s Liability coverage at the limits required under RFQ Section 2.10 as amended, with the City of Sunny Isles Beach named as Additional Insured on all coverages other than Professional Liability, per Addendum # 4, A20. A current Certificate of Liability Insurance is included in Section 1. This page states no exceptions.
