EXCEPTIONS <br />Kimley-Horn acknowledges receipt of Addendum #8, dated August 7, 2026, which adds Delay Damages (Liquidated <br />Damages) language to Section 2 – General Terms and Conditions of RFQ No. 26-07-01. We respectfully request that the <br />City remove all references to liquidated damages as they apply to design professional services. <br />We believe they are not applicable to the services of design professionals, as we do not control, set, or manage the <br />Project schedule, this is a contractor-specific issue and should be removed from the contract.
