LITIGATION <br />CITY OF SUNNY ISLES BEACH <br />CONTINUING PROFESSIONAL ARCHITECTURAL AND <br />ENGINEERING CONSULTING SERVICES (CCNA) <br />RFQ NO. 26-07-01 <br />List of any outstanding litigation that would threaten the viability of the Proposer or the performance of this <br />contract: <br />N/A <br />Provide a history of any Criminal or Civil Litigation for a five‐year (5) period of time immediately preceding this <br />Request for Proposal. <br />Case Name: 8101 FRED, LLC VS LINK CONSTRUCTION GROUP, INC. ET AL <br />Case Number: 2022-001318-CA-01 <br />Project: Continental Flowers Warehouse / Doral, Florida. <br />Link Construction vs R.E. Chisholm Architects, Inc. <br />A commercial refrigerated warehouse project (Completed 2016) … The Project Owner / Client sued the General Contractor <br />for faulty construction, and the General Contractor sued the Architect / Engineer team. <br />The litigation between the General Contractor and Owner / Client had been on-going for over (3.5) years. Chisholm <br />Architects was served with above litigation in March 2023 by the General Contractor. <br />The subject of the litigation is stucco cracks on the exterior walls of the refrigerated warehouse. It had been twice officially <br />reported by independent reports as construction flaws, not A/E design flaws. <br />Mediation began on July 31st, 2024 and was successfully completed as of September 2025 with the General Contractor. <br />R.E. Chisholm Architects, Inc. settled without admission of liability. <br />We affirm that the above-mentioned litigation has not had, nor will it have, any impact on our ability to perform the <br />Services as outlined in this agreement. R.E. Chisholm Architects, Inc. remains fully committed to delivering <br />high-quality, timely, and professional services in compliance with all contractual and regulatory obligations. <br />Should any additional information be required, we are prepared to provide further details to confirm our capacity <br />and reliability in fulfilling the requirements of this engagement. <br />Robert E.
