ELECTRICAL ENGINEERS <br />2 <br />Outstanding Litigation Affecting Firm Viability or Contract Performance <br />None. <br />SGM Engineering, Inc. has no outstanding litigation that would threaten the financial or <br />operational viability of the firm or impair its ability to perform the services required under this <br />contract. The firm is not aware of any pending or threatened action that would affect its <br />personnel, professional licenses, financial resources, insurance coverage, or ability to fulfill its <br />contractual obligations to the City of Sunny Isles Beach. <br />Five-Year Criminal and Civil Litigation History <br />Based on the firm’s records and to the best of its knowledge, neither SGM Engineering, Inc. nor <br />its principals or officers has been involved in criminal or civil litigation during the five-year period <br />immediately preceding this Request for Proposal. <br />Specifically: <br />• No civil lawsuits or legal actions have been filed by or against SGM Engineering, Inc. during <br />the required five-year period. <br />• No litigation, mediation, arbitration, trial, or appellate proceedings have been pending or <br />concluded involving SGM’s professional services. <br />• No judgments have been entered against SGM Engineering, Inc. during the required five- <br />year period. <br />• Neither SGM Engineering, Inc. nor any of its principals or officers has been charged with or <br />convicted of a criminal violation during the required five-year period. <br />• There are no case captions, case numbers, jurisdictions, forums, claim descriptions, judgments, <br />criminal charges, or convictions to report. <br />Accordingly, SGM Engineering, Inc. has no criminal or civil litigation history requiring further <br />disclosure for the five-year period immediately preceding this solicitation. <br />Proof of Insurance <br />SGM Engineering, Inc. maintains insurance appropriate for the professional engineering services <br />contemplated under this contract, including: <br />• Commercial General Liability <br />• Automobile Liability <br />• Workers’ Compensation and Employers’ Liability <br />• Umbrella/Excess Liability <br />• Professional Liability/Errors and Omissions <br />A current Certificate of Liability Insurance naming SGM Engineering, Inc. as the insured, together <br />with any required evidence of coverage or endorsements, is included immediately following <br />this section.
