RESOLUTION NO. 2015-23' 9 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A REQUEST SUBMITTED BY RDR SEASHORE, LLC TO BUILD A CONSTRUCTION FENCE WITH GRAPHICS AT THE SEASHORE CLUB SITE LOCATED AT 18975 COLLINS AVENUE; APPROVING A WAIVER OF THE LANDSCAPING AND FRONT SETBACK REQUIREMENTS; ESTABLISHING CONDITIONS FOR THE LOCATION OF THE CONSTRUCTION FENCE; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on or about February 10, 2015, RDR Seashore. LLC. ("Applicant") submitted a request to the City of Sunny Isles Beach, Florida to waive the landscaping and front setback requirements and approval of graphics for the construction fence for the Seashore Club site to facilitate the construction of the future development project; and WHEREAS. the City Commission wishes to approve the waiver to permit the Applicant with the flexibility to install the construction fence with graphics without the required setback and landscaping buffer. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they are fully set forth herein. Section 2. Approval of Murals and Graphics. The City Commission hereby approves the graphics proposed by the Applicant as set forth in Section 265-63-3 G. of the City Code. Section 3. Approval of Waiver. The City Commission hereby approves the waiver of the landscape and setback requirements set forth in Section 265-63.3 E. of the City Code, subject to the conditions below. Section 4. Conditions of Approval. The Applicant is required to comply with the following conditions: 1. The construction fence shall be maintained in good condition at all times. 2. That the sidewalk adjacent to the construction fence shall be maintained clean and in good condition at all times.
