MEMORANDUM OF UNDERSTANDING <br /> ARTICLE 10 COMPENSATION <br /> The City of Sunny Isles Beach, Florida ("the City") and the Dade County Police <br /> Benevolent Association ("PBA") hereby enter into this Memorandum of Understanding <br /> amending the current Sergeant and Officer Salary Pay Plan ("Pay Plan") set forth in Article 10 of <br /> the Collective Bargaining Agreement between the City and the PBA ("the parties") regarding <br /> increases to the Pay Plan, and; <br /> WHEREAS, the parties acknowledge that Article 10, COMPENSATION, Section 1. of <br /> the current Collective Bargaining Agreement states "The Pay Plan may be revised from time-to- <br /> time based on the total compensation survey pursuant to Section 5 below. Nothing restricts the <br /> City, at its sole discretion from starting a new employee at a higher step in order to compensate <br /> for superior experience or other such relevant considerations." and; <br /> WHEREAS the parties further acknowledge that Article 31, TERM OF AGREEMENT, , <br /> Section 3. states "It is understood and agreed that this Agreement constitutes the total agreement — .' <br /> of the parties. The terms of this agreement shall not be amended, except by the mutual written <br /> consent of the parties as they may from time to time agree.; and: <br /> WHEREAS the parties have agreed to Amend the current pay plan to reflect increases set <br /> forth in the "Amended Sergeant and Officer's Pay plan" (attached hereto and incorporated <br /> herein by reference) and have further agreed that all the remaining provisions/articles of the <br /> 2012-2015 Collective Bargaining Agreement shall remain unchanged and in full force and effect. <br /> THEREFORE based_on the provisions of the current Collective Bargaining Agreement <br /> sited above, the mutual promises contained herein and other good and valuable consideration the <br /> parties agree to modify Article 10 COMPENSATION as follows: <br /> Page 1 of 2 <br /> SIB <br />
