RESOLUTION NO. 2015- 238t4 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE RELEASE AND CANCELLATION OF THE DECLARATION OF RESTRICTIONS RECORDED IN O.R. BOOK 26192, PAGE 1229; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on or about March 4, 2009, the Florida Department of Environmental Protection ("DEP") provided the City with certain grant funds under the Florida Recreation Development Assistance Program, DEP Agreement No. A9033 (the "Grant"); and WHEREAS, the purpose of the Grant was to assist the City in its acquisition and/or development of a parcel of land commonly known as Bella Vista Park for a public park and marina; and WHEREAS, the subject land is described in the Declaration of Restrictions recorded in O.R. Book 26192, Page 1229, of the Public Records of Miami-Dade County, Florida (the "Declaration") ; and WHEREAS, the City Commission wishes to terminate the Declaration of Restrictions in order to sell the subject land. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA,AS FOLLOWS: Section 1. Approving the Release and Cancellation of the Declaration of Restrictions. The City Commission hereby authorizes the release and cancellation of the Declaration of Restrictions recorded in O.R. Book 26192, Page 1229 of the Public Records of Miami-Dade County, Florida. Section 2. Authorization of City Manager and City Attorney. The City Manager and the City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Effective Date. This Resolution shall become effective upon adoption.
