their review as the TDR Towers Project was originally constructed in accordance with said <br /> 2005 standards. <br /> 1. Building Separation §265-35 D. (5). The Association understands that to preserve ocean <br /> views for properties west of Collins Avenue, primary use buildings exceeding 20 feet in height <br /> above grade on the same site shall be separated by a minimum of 100 feet as measured <br /> parallel to Collins Avenue. <br /> a. The Association is requesting a variance to allow 0'-0"Building Separation between the new <br /> pedestal deck and existing residential Towers for the two new parking decks to be constructed <br /> instead of the existing 120'-0"separation currently in place. It is suggested that this requested <br /> variance will not have a negative impact on the surrounding community as the building <br /> separation between the Towers above the new parking decks will remain the same. <br /> 2. Building Width §265-35 D. (6). The Association understands that to further preserve ocean <br /> views for properties west of Collins Avenue, for parcels 200 feet or more in width, the <br /> maximum building width, as measured parallel to Collins Avenue, of any single structure or <br /> portion thereof exceeding 20 feet in height above grade shall be 250 feet. <br /> a. The Association is requesting a variance to allow the new pedestal height of 46'-0"to the top <br /> of the new lanai deck and 62'-8"to the top of the new pavilion structure instead of the existing <br /> 19'-11"height currently in place. It is suggested that this requested variance will not have a <br /> negative impact on the surrounding community as the pedestal height will only be increased <br /> between the residential towers. <br /> 3. Parking Spaces Dimension§265-46 A. (7)(a). The Association understands that each parking <br /> space provided pursuant to the provisions of the Code of Ordinances of Sunny Isles Beach <br /> shall be not less than 9 feet by 18 feet in length for residential developments. <br /> a. In 2005 the Code of Ordinances of Sunny Isles Beach provided that all parking spaces shall <br /> be not less than 8.5 feet by 18 feet in length it was later amended to increase the width of all <br /> parking spaces to 9 feet. The Association is requesting a variance to allow the new parking <br /> spaces to be constructed 8.5 feet wide by 18 feet in length which would be equal to the original <br /> building design as approved by the City in 2005. <br /> In further support of the Association's request for the City's approval, of the above <br /> requested variances, please be advised that it is the Association's highest priority to provide <br /> additional parking spaces within its garage without compromising the aesthetic features of the <br /> TDR Towers Project. As you may be aware the TDR Towers Project as originally constructed <br /> fails to provide enough parking spaces for the Residents, Guests and Invitees who reside and <br /> visit the property. Unfortunately, the Association inherited an insufficient number of parking <br /> spaces from the Developer and was not a party to or involved with the original project design <br /> and site approvals. During the construction of the TDR Towers Project the Developer entered <br /> into a buy down with the City and in exchange for a contribution to Off-Street Parking the <br /> Developer was approved for the reduction of 20% (244) of the required parking spaces. The <br /> loss of the previously mentioned parking spaces has had a direct impact on the Association's <br /> ability to accommodate and meet the parking needs of the TDR Towers Project. <br /> Currently, the parking demand and need on the property is so great that the Association <br /> has had to expend funds to rent additional parking spaces thereby requiring valet staff to cross <br /> Collins Avenue for the retrieval of vehicles.
