Summary Minutes:Regular City Commission Meeting February 19,2015 City of Sunny Isles Beach,Florida <br /> They are also seeking approval of a Waiver of landscaping and front setback requirements. <br /> At the request of the City and of their neighbors,they adjusted their original fence line about <br /> 20 feet from their property line southward to make sure they had proper access to their <br /> property. This will eventually be the site of their new project"Residences by Armani/Casa". <br /> Residents from the neighboring Miami Beach Club Condominium said they were concerned <br /> about a safety issue with the parking as there is no room for two vehicles side by side which <br /> means the last vehicle in would have to back out into the street as you cannot turn around in <br /> 12 feet. Stuart Zobert, Esq. representing the Miami Beach Club Condominium located at <br /> 19051 Collins Avenue said they are the neighboring property owner and had no notice of this <br /> item. He said they are already in litigation with RDR Seashore. He asked that this item be <br /> tabled for now to give them more time to prepare. Attorney Chesnick said they own the <br /> property 100%and that there is no pending litigation with a third party. Additionally, three <br /> (3) cars are parked in the back of the Miami Beach Club and it is an alleyway. The fence <br /> they are putting up is on the southern-most side of the curb cut and so it does not affect the <br /> current curb cut, egress or ingress. It is a safety issue and that is why they are putting the <br /> fence up as the property next door is abandoned. The fence height on the side that would <br /> approach the Miami Beach Club is six-feet high. It is a chain fence and in the front the fence <br /> is eight-feet with signage. They are well within their property rights,as they researched the <br /> title and they know they own that actual alleyway as well. There is no recorded easement or <br /> any other document that is recorded on the title. <br /> Commissioner Aelion asked if it was going to be an extension of the present, and Ms. <br /> Hasbun said it is going to be on Collins Avenue on the property line and to the sides and <br /> back as well. With that it is in the northwest corner by a 15-foot extension. Commissioner <br /> Aelion asked what is the setback from the sidewalk to the actual fence built at the vehicular <br /> exit? Ms. Hasbun said the requirement at the front property line is six feet but they are <br /> requesting the waiver. Unfortunately the configuration of the driveway does not provide any <br /> site plan at this moment, and so even the driveway to the north, because of the property line <br /> that runs between the two,will not be conforming. Commissioner Aelion said if you want to <br /> exit,the canvass will block the view,it is not a chain-link fence that has a see-through,it will <br /> be covered with some sort of canvass. He suggested putting in a mirror and said we have <br /> these issues often with other high-rises on the beach and the way it was resolved was by <br /> putting up a big reflecting mirror so you can see oncoming traffic or pedestrians. He clarified <br /> that the canvass will be on Collins Avenue and not protruding on an L-Shape inside,and Ms. <br /> Hasbun said the canvass will not but the fence will be. Attorney Zober asked that this <br /> application be denied or tabled. He did not know that the litigation was resolved. <br /> Commissioner Levin asked about the ownership again, and Attorney Chesnick said RDR <br /> Seashore owns the Seashore Club 100%, and the Miami Beach Club is owned by 108 <br /> different condominium unit owners. City Attorney Ottinot said the Applicant did provide the <br /> City with proof of ownership, and we reviewed it. He said Attorney Zobert came to him the <br /> night before about this and he indicated to them that if they are going to prove their easement <br /> he needs to bring him some kind of legal document to support that. Commissioner Levin <br /> asked with the driveway that is there, is it possible for it to work? Ms. Hasbun said as it <br /> shows,no it is not,unfortunately they would not have access to it. Commissioner Levin said <br /> the carve out piece is for sight and that is where people would have to back out? Ms.Hasbun <br /> • 0 <br />
