Summary Minutes:Regular City Commission Meeting April 16,2015 City of Sunny Isles Beach,Florida <br /> 1 and we said okay, we are not going to build in those parks, and we are going to move that <br /> density someplace else. We have an item on the agenda tonight where we are going to take a <br /> piece of land from a developer in exchange for TDRs so that we end up with a park and they <br /> are going to end up with a taller building. Quite frankly some of those TDRs are probably in <br /> this building, and so it really is a win-win. In some cases we just get the TDRs and when a <br /> developer needs them they purchase them and that gives us the money to make a lot of capital <br /> improvements around the City. It is not always intuitive unfortunately, some of this stuff <br /> seems abstract but he can assure you that the one thing we are focused on now and he brought <br /> it up a few months ago as Commissioner Aelion, is traffic, and we have a Comprehensive <br /> Traffic Study on the agenda tonight, and we are going to fund that. We are going to have a <br /> traffic safety, and a pedestrian safety component of that study and so we are embarking on a <br /> pretty comprehensive analysis of where the traffic is coming from, what we might be able to <br /> do to mitigate it, and most importantly how we keep increasing pedestrian safety because that <br /> is one of our main concerns. Usually when the public is upset and when the developer is upset <br /> we have done our job because the public wants to take all the developers rights away which we <br /> can't do because we have a Code and developers come into the City and they buy property <br /> based on a reliance on the Code and if you start stripping those rights away we subject <br /> ourselves to endless mitigation. That just happened in Hollywood recently; Hollywood down <br /> zoned and they are facing a multitude of litigation and ultimately the City is paying for that. <br /> What we continue to focus on is ways to try to figure out how to mitigate the issues. <br /> Ultimately when they come in with an as-of-right project, like they did today, the developer <br /> could come in. and usually they come in asking for a bunch of variances but he thinks <br /> everybody has gotten the message that your variances under this Commission is not acceptable <br /> unless there are extraordinary circumstances. It doesn't mean that variances are always bad <br /> because there are sometimes issues that require variances. What we have been trying to do is <br /> to hold the line especially on the west side of Collins Avenue because ultimately we are <br /> watching the development activity there very carefully. <br /> Commissioner Aelion moved and Vice Mayor Gatto seconded a motion for approval, <br /> subject to staff conditions.
