Summary Minutes:Regular City Commission Meeting April 16.2015 City of Sunny Isles Beach,Florida <br /> possible and they promise to deliver a very fine product. We are going to be increasing the <br /> number of units and this was in response to a very great demand that they have had for the <br /> initial sales on the first tower. They decided to do everything at one time and van the size of <br /> the units and this way they will come out with approximately the same square footage. <br /> Cliff Schulman. Esq. said also on their off-site parking, they are only required to have 54 <br /> spaces but they will be having 79 spaces by using the new Ordinance that the City passed <br /> which is design flexibility on setbacks. We are also increasing the tower width by 121 feet for <br /> the north tower to 164 feet but 250 feet would be allowed under the Code. <br /> Architect Larry Freedman presented the site plan modification that they are proposing. <br /> Originally they had two (2)towers that were identical,two(2)units per floor, one to the north <br /> and one to the south. What they are now proposing is to keep the original tower as is, and <br /> create a new slightly broader tower on the north section that would have four (4) units per <br /> floor. Both buildings are the same in height at about 650 feet. Mr. Schulman said while they <br /> are the same height, the number of floors has actually been reduced because of the higher <br /> ceiling. Mr. Freedman said yes, on the north tower we have two (2) less floors which is why <br /> we have a little less square footage in that tower. <br /> Mr. Schulman said they are not requesting any variances, this is a previously approved site <br /> plan, and again the only question they had was for clarification of Condition No. 4 to indicate <br /> that the off-site lot would be used for parking purposes and any other purposes that are <br /> permitted under the City's Zoning Code. <br /> Mayor Scholl opened the public hearing to hear from residents. Attorney Wilson C.Atkinson <br /> representing the firm of Tripp Scott for the 18001 Collins Avenue Condominium Association, <br /> who will be directly affected by this building that is going up. They have advised their client <br /> that yes they are coming before the Commission as-of-right but their concern is that they feel it <br /> was represented to them at the September 2014 City Commission meeting that the developer <br /> would in fact speak with them so that their issues and their concerns could be addressed. The <br /> President has advised him that on numerous occasions he has attempted to do so,and the most <br /> recent conversation that has been within the last 30 days and he was told that they did not <br /> realize that they had not spoken to you but unfortunately they don't have the authority to do so, <br /> and they will have to have their legal counsel speak to them. This was said during the time <br /> when these gentlemen knew they were coming before the City with a modification of their site <br /> plan. He asked that the Commission continue this meeting for at least 30 days to give these <br /> gentlemen the opportunity to meet the obligation that they imposed upon themselves back in <br /> September and subsequently with his client. Mr. Schulman said he was not contacted and no <br /> one in the Chambers were contacted but he will give his personal representation that he will <br /> arrange for that meeting to take place, and if Mr. Atkinson from Tripp Scott will give him his <br /> card he will start making those arrangements tomorrow morning. Being there were no other <br /> speakers, Mayor Scholl closed the public hearing. <br /> Commissioner Levin asked b which Condominium was he representing, and City Attorney <br /> Ottinot said Trump Hotel to the north. Commissioner Levin asked what the reason was for <br /> changing the size of the building to the north? You didn't change the size of the building to <br /> the south, correct?
