Summary Minutes:Regular City Commission Meeting April 16.2015 City of Sunny Isles Beach,Florida <br /> of a community thing, not a private thing and it would behoove us not to burden such an <br /> organization. Commissioner Levin asked if it was a commercial unit, and Kevin Thomas <br /> said the restaurant is but the auditorium is not. Mayor Scholl noted that the auditorium is a <br /> common element. <br /> Commissioner Aelion moved and Commissioner Levin seconded a motion to approve the <br /> proposed Ordinance on first reading. The motion was approved by a roll call vote of 5- <br /> 0 in favor. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, Amending <br /> Chapter 265-54 of the City Code to Require a Permit for Substantial Repairs of Signs; <br /> Providing for Severability; Providing for Repeal of Conflicting Provisions; Providing for <br /> Inclusion in the Code; and Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and Planning and Zoning Administrator Claudia <br /> Hasbun reported that in our Code, signs can be painted or re-painted without the need of a <br /> building permit but basically they are changing more than just painting the sign. We have <br /> been trying to keep our uniform sign plan and it has been difficult. <br /> Public Speakers: None <br /> Commissioner Aelion said he has an issue with this as a monument sign in the commercial <br /> section gets too much sun and fades out. The business orders a vendor to come and replace <br /> that sign, meaning that it is a plastic piece that goes into a slot to replace the other one. A <br /> new sign cost$300 to$500 and sometimes more,and he doesn't think the business should be <br /> penalized because of the sign cracking.etc. Wit involved new electrical issues,inside repair <br /> etc., he would understand that but he thinks we should be more accommodating to the <br /> businesses when it comes to just changing a sign. The way it is written it says"minor repairs <br /> of$50...". That is wishful thinking.there is nothing$50.00. and when you say"substantial <br /> repairs" it is not clarified. He thinks there should be more guidance for this proposal. <br /> Planning and Zoning Administrator Claudia Hasbun said if they are refreshing their sign by <br /> painting it because it faded from the sun, that is okay because basically it is the same sign. <br /> The problem is when they are doing changes to those approved signs. Commissioner Aelion <br /> said the language is too generalized, it needs to be clearer. Mayor Scholl said when they <br /> come to staff it will be clear but what Claudia is saying is that staff has a problem. They <br /> abstract their rights to do something and they get away from the Sign Ordinance. Deputy <br /> City Manager Morris said what is happening is the problem has been when people have used <br /> the section of the Ordinance to repaint or somehow expand an existing sign without a permit <br /> and so really this is about cleanup. Ultimately we always have to apply reasonability where <br /> applying the Code. For the examples that Commissioner Aelion has given. he thinks what <br /> 19 <br />
