Irerracon <br />February 27, 2015 <br />To Whom It May Concern: <br />Terracon is a large engineering firm specializing primarily in geotechnical, environmental, and <br />construction materials testing and we perform tens of thousands of projects nationwide. <br />Cii <br />Wi ►ns in the State of Florida, there have been no citations from any <br />regulatory authorities. Outside the State of Florida, we have had the below listed OSHA citations <br />in the past 5 years. <br />u February 2010: A contract employee working for Terracon on an Illinois project was cited by OSHA for being <br />near the edge of a flat roof approximately 18 feet above the ground without fall protection. Terracon <br />investigated the incident and concurred that the employee was in fact working near the edge of the building <br />without fall protection. We required the employee's employer to retrain all their employees who might be <br />required to work at heights on a Terracon project site. Documented training was received. Terracon entered <br />into an expedited informal settlement agreement with OSHA and received a 30% reduction in the proposed <br />penalty. 1926.501 (b)(1) <br />October 2012: A Terracon employee working at a Texas construction project was cited by OSHA for working <br />in an aerial lift without fall protection. The employee was observed drilling a core sample at a height of <br />approximately 8 feet above the ground. Terracon investigated the incident and determined the employee <br />had been appropriately trained in fall protection and use of the aerial lift, provided the correct fall protection <br />equipment and failed to use it on this project. He was disciplined and had to accompany Terracon <br />management to an informal conference with the OSHA area director. Terracon entered into an informal <br />settlement agreement reducing the penalty by 50% and one citation reduced to "Other- than - Serious ". 1910.67 <br />(c)(2)(iv) and (v) <br />Litigation /Arbitration Claims <br />With regard to our operations in Florida who could perform services on the proposed contract, we <br />have had the following litigation in the past 5 years. <br />* Bernardo v.
