• <br /> RESOLUTION NO. 2014-2,312. <br /> A RESOLUTION OF THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE <br /> ORDER NO. 1 TO THE AGREEMENT WITH PAC COMM INC. <br /> TO PROVIDE CONSTRUCTION SERVICES FOR THE <br /> INTRACOASTAL SEAWALL EMERGENCY REPAIR <br /> PROJECT, IN AN AMOUNT NOT TO EXCEED FOUR <br /> HUNDRED THOUSAND NINE HUNDRED EIGHTY-TWO <br /> DOLLARS AND NINETY-FIVE CENTS ($400,982.95), <br /> ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE <br /> CITY MANAGER TO DO ALL THINGS NECESSARY TO <br /> EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, on September 18, 2014 via Resolution No. 2014-2295, the City ratified an <br /> Agreement with Pac Comm, Inc. to perform construction services for the Intracoastal Seawall <br /> Emergency Repair Project, in a total amount not to exceed Nine Hundred Fifty-Two Thousand <br /> Nine Hundred Eighteen Dollars and Five Cents ($952,918.05); and <br /> WHEREAS, the City's Consultant Calvin Giordano and Associates, Inc. (CGA) <br /> performed additional evaluation of the seawall and determined that additional repair or <br /> replacement work is needed on both the North and South Intracoastal Parks, and DERM approved <br /> the revised limits of repair and replacement; and <br /> WHEREAS, Pac Comm, Inc. has estimated the additional quantities and cost, which have <br /> been reviewed by CGA, in an amount of $377,557.95, plus $23,425.00 for backfill for a total <br /> amount not to exceed Four Hundred Thousand Nine Hundred Eighty-Two Dollars and Ninety- <br /> Five Cents ($400,982.95), bringing the total contract amount not to exceed to One Million Three <br /> Hundred Fifty-Three Thousand Nine Hundred One Dollars ($1,353,901.00); and <br /> WHEREAS, the City desires to approve Change Order No. 1 to the Agreement with PAC <br /> Comm Inc. to perform construction services for the Intracoastal Seawall Emergency Repair <br /> Project, in a total amount not to exceed Four Hundred Thousand Nine Hundred Eighty-Two <br /> Dollars and Ninety-Five Cents ($400,982.95), attached hereto as Exhibit "A". <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Approval of Change Order No. 1 to Agreement. The City Commission hereby <br /> approves Change Order No. 1 to the Agreement with PAC Comm Inc. to provide construction <br /> services for the Intracoastal Seawall Emergency Repair Project, in an amount not to exceed Four <br /> Hundred Thousand Nine Hundred Eighty-Two Dollars and Ninety-Five Cents ($400,982.95), <br /> attached hereto as Exhibit "A". <br /> Section 2.
