E. Gender expression shall mean all of the external characteristics and behaviors that are <br /> socially defined as either masculine or feminine. such as dress, grooming. mannerisms. <br /> speech patterns and social interactions. Social or cultural norms can vary widely and <br /> some characteristics that may be accepted as masculine, feminine or neutral in one <br /> culture may not be assessed similarly in another. <br /> F. City shall mean the City of Sunny Isles Beach. <br /> § 172-4. —Extension of anti-discrimination protections to persons based on gender identity <br /> or gender expression. <br /> A. It shall be prohibited to discriminate against any person, based on their Render identity <br /> or gender expression, in providing services. programs. or activities offered by the City. <br /> Additionally. it shall be prohibited to discriminate against any person, based on their <br /> gender identity or Render expression. in hiring for employment and the conditions of <br /> employment with the City. <br /> B. The anti-discrimination policies of the City shall provide protections for persons based <br /> on gender identity or Render expression as provided by law. A person who has declared <br /> a transgender identity shall be entitled to any benefits provided by the City under its <br /> policies provided that the person is eligible for such benefits. <br /> C. Notwithstanding any provision in this Chapter.the City has the right to provide services. <br /> programs, or activities. and administer its employment practices. based on bonafide. <br /> non-discriminatory business decisions. <br /> § 172- 45. —Charitable Donations. <br /> A. Financial Donations. Cash donations to charitable organizations must be approved by <br /> the affirmative votes of at least four members of the City Commission at a public <br /> meeting. <br /> B. In-Kind services and Use of Facilities. In-kind services and use of the City's <br /> governmental facilities by charitable organizations must be approved by the affirmative <br /> votes of at least four members of the City Commission at a public meeting. <br /> Section 3. Severability. The provisions of this Ordinance are declared to be severable and if <br /> any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid <br /> or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, <br /> clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent <br /> that this Ordinance shall stand notwithstanding the invalidity of any part. <br /> Section 4. Inclusion in the Code.It is the intention of the City Commission, and it is hereby <br /> ordained, that provisions of this Ordinance shall become and be made a part of the Code of <br /> Ordinances of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may <br /> be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be <br /> changed to "section" or other appropriate word, as required. <br /> Section 5.
