E. Gender expression shall mean all of the external characteristics and behaviors that are socially defined as either masculine or feminine. such as dress, grooming. mannerisms. speech patterns and social interactions. Social or cultural norms can vary widely and some characteristics that may be accepted as masculine, feminine or neutral in one culture may not be assessed similarly in another. F. City shall mean the City of Sunny Isles Beach. § 172-4. —Extension of anti-discrimination protections to persons based on gender identity or gender expression. A. It shall be prohibited to discriminate against any person, based on their Render identity or gender expression, in providing services. programs. or activities offered by the City. Additionally. it shall be prohibited to discriminate against any person, based on their gender identity or Render expression. in hiring for employment and the conditions of employment with the City. B. The anti-discrimination policies of the City shall provide protections for persons based on gender identity or Render expression as provided by law. A person who has declared a transgender identity shall be entitled to any benefits provided by the City under its policies provided that the person is eligible for such benefits. C. Notwithstanding any provision in this Chapter.the City has the right to provide services. programs, or activities. and administer its employment practices. based on bonafide. non-discriminatory business decisions. § 172- 45. —Charitable Donations. A. Financial Donations. Cash donations to charitable organizations must be approved by the affirmative votes of at least four members of the City Commission at a public meeting. B. In-Kind services and Use of Facilities. In-kind services and use of the City's governmental facilities by charitable organizations must be approved by the affirmative votes of at least four members of the City Commission at a public meeting. Section 3. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 4. Inclusion in the Code.It is the intention of the City Commission, and it is hereby ordained, that provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Sunny Isles Beach, Florida; and that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "ordinance" shall be changed to "section" or other appropriate word, as required.
