B. Purchases more than $2,500.00 but less than $25,000.00 $50,000.00. Purchases of, or
<br /> contracts for, materials, supplies, equipment, improvements or services for which funds
<br /> are provided in the budget, where the total amount to be expended is in excess of
<br /> $2,500.00, but which do not exceed X000.00 $50,000.00 may be made, or entered into,
<br /> by the City Manager without submittal to the City Commission, but shall require
<br /> compliance with the informal competitive bidding requirements set forth in § 62-6 and
<br /> 62-7 of this chapter. Single purchases or contracts in excess of $25,000.00 $50,000.00
<br /> shall not be broken down to amounts less than $25,000.00 $50,000.00 to avoid the
<br /> requirements of this section.
<br /> C. Purchases in excess of$2 000.00 $50,000.00. The City Commission shall approve all
<br /> purchases of or contracts for materials, supplies, equipment, public improvements of
<br /> services where the total amount to be expended is more than $25,000.00 $50,000.00.
<br /> Notwithstanding this provision, purchases in excess of$25,000.00 $50,000.00 for utilities
<br /> shall be administratively approved in the adopted fiscal year budget and are not subject to
<br /> the requirements of Chapter 62 of the Code unless required by the City Commission. For
<br /> purposes of this exemption, the term "utilities" shall include electrical, water, natural gas
<br /> (excluding fuel/diesel purchases), sewage and solid waste collection, and
<br /> telecommunication services including but not limited to cable television, telephone lines,
<br /> internet connectivity, data and voice circuits, voice over internet protocol ("VOIP"),
<br /> cellular/wireless phones, wide area network ("WAN") connectivity, pagers, and wireless
<br /> adapters for cellular data ("air cards").
<br /> D. Purchases in excess of $25,000.00 $50,000.00. For purchases in excess of U-54)00410
<br /> $50,000.00 the City Commission shall follow the formal provisions contained in §62-7
<br /> below.
<br /> § 62-7. Competitive bidding procedure.
<br /> A. Purchases under$ 000-00 $50,000.00.
<br /> (1) Whenever competitive bidding is required by this chapter, the City Manager shall
<br /> direct that bid proposals which provide specifications for the purchase or contract be
<br /> prepared.
<br /> (2) The City Manager shall solicit bids from at least three persons or entities engaged in
<br /> the business of furnishing such materials, supplies, equipment and public
<br /> improvements or rendering such services.
<br /> (3) The City Manager may publish a public invitation to bid items under $ 000.00
<br /> $50,000.00.
<br /> B. Purchases over $257000,00 $50,000.00. Bids for purchases over $25,000.00 $50,000.00
<br /> shall be awarded to the lowest responsible and responsive bidder whose bid best serves
<br /> the interests of and represents the best value to the City, in conformity with the criteria
<br /> set forth in §62-8 of the City Code. Price is only a factor in determining the lowest
<br /> responsible responsive bidder. For purposes of this section, the term "lowest responsible
<br /> and responsive bidder" is not the bidder with the lowest dollars and cents bid. The City
<br /> Manager or the City Commission may select a bidder whose bid is not the lowest dollars
