Sole <br /> Secretary <br /> FEB 2 6 2009 <br /> February 17, 2009 <br /> Dear Storage Tank System Owner: <br /> The Department of Environmental Protection's records indicate that you own and/or <br /> operate petroleum storage tanks that are not upgraded with secondary spill containment. The <br /> Department has posted a listing of tank systems needing upgrades on our website at: <br /> http://www.dep.state.fl.us/waste/categories/tanks/default.htm <br /> The deadline for upgrading single-wall underground storage tanks and piping with <br /> double-wall systems is December 31, 2009. The deadline for upgrading field-erected <br /> aboveground storage tanks that do not have secondary containment beneath the tank is <br /> January 1, 2010. <br /> It has been our experience from the eight previous Storage Tank Rule upgrade <br /> deadlines that many facility owners choose to wait until the last minute to upgrade their tanks. <br /> Unfortunately, there is usually a short supply of qualified contractors and storage tank system <br /> equipment available to meet the demand, and many owners and operators pay higher prices for <br /> the upgraded systems because they wait until the last minute. Those that missed the previous <br /> deadlines faced Department enforcement actions and paid penalties for noncompliance. <br /> Conversely, owners that upgraded early paid less for equipment and labor, received quicker and <br /> higher quality service, and have saved money on insurance premiums and compliance. <br /> Although there are many inquiries regarding time extensions, the Department intends to <br /> enforce the deadlines. The upgrade rules have been in effect since 1991, so storage tank <br /> system owners and operators have had adequate notice of the requirements and time to — <br /> comply. In addition, owners and operators have been repeatedly reminded of the deadlines by <br /> county inspectors, registration notices, and other Department public information efforts.
