Summary Minutes:Regular City Commission Meeting June 18,2015 City of Sunny Isles Beach,Florida <br /> 7. ORDINANCES FOR FIRST READING <br /> 7A. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida,Amending <br /> Section 265-5 of the City Code Entitled "Definitions" to Clarify the Meaning of Height; <br /> Providing for Severability; Providing for Repeal of Conflicting Provisions; Providing for <br /> Inclusion in the Code; and Providing for an Effective Date. <br /> Action: City Clerk Hines read the title, and City Attorney Ottinot said that the Commission <br /> had directed staff to control,especially on the west side,with respect to the maximum height. <br /> Planning and Zoning Administrator Claudia Hasbun reported this Ordinance clarifies the <br /> definition of"height". We had a height limitation for a building with structures, basically <br /> above that they could go and up to that with their mechanical equipment,and other structural <br /> elements on the rooftop of their building. Now we are trying to define that everything has to <br /> be within that height limitation. <br /> Public Speakers: None <br /> Mayor Scholl clarified that on the east side of Collins Avenue we had a height limitation <br /> which was the absolute number and we have been mainly relying on the FAA who say that <br /> 500 feet is the height and you can't go an inch above that. On the west side of Collins, it was <br /> a little more flexible, and so if you had a 190-foot height limitation for instance,traditionally <br /> the mechanical on the roof was allowed to go above that. As we continue to try to mitigate <br /> the west side of Collins Avenue density, we are getting clarity on this issue. And so if we <br /> pass this Ordinance it will be an absolute height limitation on the west side so that it is <br /> completely clear to developers that it has a hard ceiling. <br /> City Attorney Ottinot said there will be an amendment in respect to steeples,steeples will not <br /> be permitted over 42 inches. <br /> Commissioner Goldman moved and Vice Mayor Gatto seconded a motion to approve the <br /> proposed Ordinance on first reading,as amended. The motion was approved by a roll <br /> call vote of 5-0 in favor.
