39 <br />TAB L - CLAIMS AND LITIGATION HISTORY <br />LITIGATION HISTORY <br />Since our inception in 1968, Pirtle Construction Company has had zero <br />litigation, major disputes or contract defaults with an Owner or Architect on <br />any of our projects. We are very proud of our spotless professional record <br />- it is a real representation of our competence, diligence and attention <br />to detail and it attests to the quality of our expertise in construction and <br />construction management. <br />While we are proactive in preventing accidents from occurring on our <br />projects, in the course of doing construction, minor workers’ compensation <br />claims arise. Most of these are inconsequential cases into which <br />Pirtle Construction is brought by a subcontractor or other party. Pirtle <br />Construction makes it a top priority to promptly make every effort to resolve any potential dispute as soon as an issue is <br />discovered, and prides itself on being proactive and finding reasonable solutions to any problem. The claims below are our only <br />claims over $50,000 in the past 5 years: <br />Claim #: 182-122830 and 13-00679-CA-05 <br />Claimant Name: Yolanda Jones, Robert Marana, Francisco Linunzo, Enrique Chavez, Robert Novo, Albert Remedies <br />Accident Date: 4/01/10- 9/30/10 <br />Jobsite: College of Policing <br />Loss Description: It was discovered that the gun range that is part of the College of Policing was not utilized and maintained <br />properly by the users after construction was completed. As the result the claimant alleges that plaintiffs were exposed to toxic <br />fumes, chemicals & residue from improper operation of gun range by the City and sued everyone involved in the project, <br />including the City of Miami, engineers and the contractor (Pirtle Construction). <br />Current Status: Case was settled with claimants Jones, Marana, Linunzo and Chaves. We are currently in negotiation to settle <br />with the remaining claimants. (Separate case number 13-00679-CA-05 for Robert Novo and Albert Remedies) <br />Claim #: 002547-010221-GB-01 <br />Claimant Name: Joseph Cavalet and Sheila Cavalet <br />Accident Date: 12/2010 <br />Jobsite: Adjacent to the JJJ High School <br />Loss Description: Complaint alleges that the injuries the plaintiffs suffered while going over a speed bump that is adjacent to the <br />JJJ High School on their motorcycle were due to the speed bump being unidentified by any traffic sign. The Complaint brings a <br />cause of action for negligence against numerous defendants, including the City of Coral Springs, Pirtle Construction, the project <br />architect and the civil engineer. <br />Current Status: The plaintiff’s current position is that the speed bump was higher than FDOT requirements. Because the <br />Engineering firm had contract administration, they may have exposure for improper final inspection. At this time we see <br />minimal exposure for Pirtle Construction. <br />Claim #: CACE-14-009129 <br />Claimant Name: Zachary Evans <br />Accident Date: 5/19/2012 <br />Jobsite: Young at Art Museum <br />Loss Description: The county hired a display company to fabricate and mount displays. They attached the large hanging displays <br />to the chilled water pipes. (This is not an approved location for hanging displays.) When the child pulled on the display, the <br />insulator for the metal pipe hanger fell and struck the child on the nose creating a small cut. Pirtle Construction has filed a <br />motion to release us from the case due to the fact that Redbox improperly connected the cables after the project was turned <br />over. <br />Current Status: Mediation <br />Claim #: E2850932 <br />Claimant Name: Palm Beach Board of Education <br />Date Filed: August 2014 <br />Loss Description: Some Fire Sprinkler Heads have minor leaks in numerous District schools, including several built by Pirtle. <br />While the School Board is investigating the cause for the leak, Pirtle Construction has already began repairs, working closely <br />with the Maintenance Department as a proactive partner. <br />Current Status: Pending <br />Since our inception in 1968, Pirtle Construction <br />Company has had zero litigation, major disputes <br />or contract defaults with an Owner or Architect <br />on any of our projects.
