Summary Minutes:Regular City Commission Meeting, July 16,2015 City of Sunny Isles Beach,Florida <br /> Code, with what we have been given subject to some substantial change or modification. <br /> We are now doing a comprehensive study of the Comprehensive Plan right now. She would <br /> not like to see the City get involved in litigation because we pushed the dveloper, they did <br /> everything we asked them to do and then some, and then we said no we are not going to let <br /> you build the project. One other thing that she had asked at the staff meeting was is there <br /> going to be a separate Declaration of Restrictions recorded that will indicate that the ground <br /> floor will only be used for business purposes? Mayor Scholl and City Atiomey Ottinot both <br /> replied yes. <br /> City Attorney Ottinot said for the record, one condition was the proffer made by the <br /> developer where he said that restaurant use has been prohibited in perpetuity; second, that <br /> the developer will provide a staging plan; and third, the three (3) Medjool Palm Trees <br /> located in the front that the City installed, the developer has agreed to relocate those Palm <br /> Trees and put them back when the project is done. Mayor Scholl saidladded or replace <br /> them, and he asked if the developer is in agreement with these conditions, and Mr. <br /> Wasserman said yes, they are in agreement with these conditions. <br /> Commissioner Aelion moved and Commissioner Levin seconded a motion for approval, <br /> subject to staff conditions, as amended. The <br /> Applicant is requesting the following: (1) a new traffic circulation pattern for ingress and <br /> egress of trucks on Collins Avenue; (2) an ingress for vehicles on Collins Avenue with an <br /> elimination of vehicles egress on Collins Avenue; (3) a solid roof covering; and (4) a <br /> modification to the requirement to underground utilities from 1831 Street to Collins <br /> Avenue. <br /> Requests: <br /> 1.
