If after award of a building permit, modifications to the Drawings <br /> and Specifications are required because of an interpretation by the Code Authority which had not <br /> been previously given, or which if given, was different than a prior interpretation by the Code <br /> Authority, Architect shall make the required modifications, but the cost of such modifications <br /> shall be considered an Additional Service, except if the Architect had construed the interpretation <br /> incorrectly in accordance with the professional standard of care. Nothing contained herein shall <br /> relieve the Architect of its obligations to modify at its own expense Plans and Specifications <br /> which the Architect has negligently failed to prepare in compliance with the applicable <br /> Government Requirements. <br /> 3.5 BIDDING PHASE <br /> (I) The Contractor shall be responsible for administering the bidding of each Bid <br /> Group. <br /> (2) The Architect shall evaluate product equals at the request of the Contractor and <br /> make a decision on each in a timely manner. <br /> (3) The Architect shall attend the pre-bid conference and bid opening for each Bid <br /> Group. <br /> (4) The Architect will assist the Contractor in evaluating all bids received and provide <br /> comment and recommendation to the Owner on each proposed authorization for <br /> work in connection with the Project. <br /> 3.6 CONSTRUCTION PHASE <br /> 3.6.1 Construction Phase — Administration of the Construction Contract Work under <br /> Contract to Contractor. <br /> (1) The Construction Phase will commence with a written authorization from the <br /> Project Director for Construction to begin and, together with the Architect's <br /> obligation to provide Basic Services under this Agreement, will terminate when <br /> final payment to the Contractor is made, or in the absence of a final Certificate for <br /> Payment or of such due date, 30 days after the date of Substantial Completion of <br /> the total Project, whichever occurs first. <br /> I C1415- PERKINS& WILL ARCHITECTS INC. 7 j is <br />
