RESOLUTION NO. 2015- 2492, A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A MAINTENANCE AGREEMENT WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION (FDOT) FOR THE INSTALLATION OF SIDEWALK PAVERS ON COLLINS AVENUE, IN SUBSTANTIALLY THE SAME FORM ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENT; AUTHORIZING THE CITY ATTORNEY AND THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS AGREEMENT; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach (the "City") requires developers to install decorative pavers in front of their properties; and WHEREAS, the Florida Department of Transportation ("FDOT") and the City agree to enter into a Sidewalk Payers Maintenance Agreement ("Agreement") for decorative sidewalks; and WHEREAS, the City Commission wishes to approve the Agreement in substantially the same form as attached Exhibit "A". NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of the Maintenance Agreement. The City Commission hereby approves the Sidewalk Pavers Maintenance Agreement between the FDOT and the City to install decorative sidewalk pavers on Collins Avenue in substantially the same form as the attached Exhibit "A". Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute the Agreement in substantially the same form as the attached Exhibit "A". Section 3. Authorization of City Manager and City Attorney. The City Manager and City Attorney are authorized to do all things necessary to effectuate the terms of the Agreement. Section 4. Effective Date.
