ORDINANCE NO. 2015 - y tfi <br /> AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF <br /> SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 265-21 <br /> ("CERTIFICATES OF OCCUPANCY") OF THE CODE OF ORDINANCES <br /> TO CLARIFY THAT A CERTIFICATE OF OCCUPANCY MAY BE <br /> REVOKED OR SUSPENDED BY THE CITY UPON THE OCCURRENCE <br /> OF CERTAIN CONDITIONS; PROVIDING FOR SEVERABILITY; <br /> PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR <br /> REPEAL OF CONFLICTING PROVISIONS; AND PROVIDING FOR AN <br /> EFFECTIVE DATE. <br /> WHEREAS, the purpose of Section 265-21 ("Certificates of occupancy") of the Code of <br /> Ordinances of the City of Sunny Isles Beach ("City Code") is for development review standards <br /> for Certificates of Occupancy for buildings and structures located in the City; and <br /> WHEREAS, Section 265-21 of the City Code provides that a Certificate of Occupancy <br /> shall be issued only after the premises have been inspected and found to be in compliance with the <br /> building code and all applicable standards and requirements for the zoning district in which the <br /> building or structure is located; and <br /> WHEREAS, the City desires to amend Section 265-21 of the City Code to mirror the <br /> authority that the Building Official has under the Florida Building Code regarding the revocation <br /> of a Temporary Certificate of Occupancy and Certificate of Occupancy. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY <br /> OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: <br /> Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified <br /> and confirmed as being true and correct and are hereby made a specific part by this Ordinance <br /> upon adoption hereof <br /> Section 2. Amendment. Section 265-21 of the City Code is amended to read as follows: <br /> § 265-21.—Certificates of occupancy. <br /> A. Purpose and effect. No new building or structure shall be used or occupied unless and <br /> until a certificate of occupancy or completion has been issued by the Building Department. No <br /> addition or structural alteration to any existing building or structure, other than a single-family <br /> detached dwelling, shall be used or occupied until and unless a certificate of occupancy or <br /> certificate of completion has been issued by the Building Department. No new nonresidential <br /> use, and no change in the occupancy of an existing nonresidential use, shall be established until <br /> and unless a certificate of occupancy or completion has been issued by the Building Department. <br /> B. Standards and review.
