Sunny Isles Beach, will also suffer, to a greater and different <br /> extent than the community at large, damage in the form of <br /> negative impacts on the value of their property, negative <br /> traffic hazards directly affecting them and their property, <br /> noise and visual impacts, reduction of physical safety, and <br /> other impacts, all of which the City' s Comprehensive Plan <br /> (particularly its Intergovernmental Coordination Element) is <br /> designed to protect them from as affected and aggrieved persons . <br /> BACKGROUND FACTS <br /> 11 . On June 16 , 1997 , defendant City of Sunny Isles Beach <br /> was incorporated as a municipality. Pursuant to Section 8 . 3 of <br /> the City' s Charter, the City formally adopted the entire Miami- <br /> Dade County Code and all of its "codes, ordinances, and <br /> resolutions" in effect on its date of incorporation. <br /> 12 . Subsequent to incorporation, on October 5, 2000 , the <br /> City adopted a Comprehensive Plan to articulate a .vision of the <br /> future land development within the City' s boundaries . A true <br /> and correct copy of the Comprehensive Plan is attached to this <br /> Complaint as Exhibit "A" and incorporated herein. <br /> 13 . In an effort to implement the vision of future land <br /> development within the City' s boundaries established by the <br /> City' s Comprehensive Plan, the City drafted and subsequently <br /> prepared for consideration and adoption a comprehensive set of <br /> 4 <br /> SHUBIN & BASS, RA. <br />
