Summary Minutes:Regular City Commission Meeting October+6 23,2003 City of Sunny Isles Beach,Florida <br /> Regulations Ordinance No. 2002-165, Attached as Exhibit "A"; Providing for an <br /> Effective Date. <br /> Action: City Clerk Hines read the title and Mayor Edelcup reported. <br /> Public Speakers: Cecile Sippin; Henry Kay <br /> Commissioner Thaler moved and Vice Mayor Goodman seconded the motion. LPA <br /> Resolution No. 2003-10 was adopted by a voice vote of 4-0 in favor. <br /> 8D.2 An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida, <br /> Repealing Ordinance No. 2003-171 Amending Section 703.8.4 (m) of the Land <br /> Development Regulations Adopted by Ordinance No. 2002-165 Entitled "Parking <br /> Garage/Rooftop Open Space"to Provide that Parking Structures that Fall Within the VE <br /> Zone on Lots with 100 Feet of Frontage or Less, are Exempt from Minimum Side <br /> Setbacks and Do Not Count Against Floor Area Ratio; Providing for a Repealer; <br /> Providing for Severability and Providing for an Effective Date. <br /> (First Reading 9/18/03) <br /> Action: City Clerk Hines read the title and Mayor Edelcup reported. <br /> Public Speakers: Cecile Sippin; Henry Kay; Bud Scholl <br /> Commissioner Iglesias noted that there are only three 100-foot lots left,and that at no time <br /> was the Sayan Tower ever to be built from lot line to lot line, that is a misunderstanding, <br /> and the only thing that was set on the VE Zone was that FEMA regulations required <br /> break-away walls to allow it to be expanded on the level of the garage under the 20-feet. <br /> He said that he supported it because the City was pushing against large garages. <br /> Commissioner Iglesias offered a compromise to allow not a 15-foot, but a 20-foot beach <br /> access, and the Commission would decide on which side the beach access should be built <br /> on. <br /> City Attorney Dannheisser clarified that the City has a set of Land Development <br /> Regulations that is very clear that one can apply for variances,and the only thing that has <br /> changed is that in order to get a variance, you have to demonstrate a hardship. She also <br /> noted that the hardship is not an economic hardship, it means that the land will not <br /> accommodate any development with a reasonable return. <br /> Vice Mayor Goodman moved and Commissioner Thaler seconded a motion to adopt the <br /> ordinance. Ordinance No. 2003-183 was adopted by a roll call vote of 3-1 <br /> (Commissioner Iglesias opposed) in favor. <br /> Vote: Commissioner Iglesias no <br /> Commissioner Thaler ves <br /> Vice Mayor Goodman <br /> Edelcup yes <br /> 7 <br />
