No. PZ2015-16 <br /> RECOMMENDATION: <br /> Based on the review by City's Staff and City's Consultants, the <br /> application is consistent with the City's Comprehensive Plan and Land • <br /> Development Regulations. The Applicant is not requesting any <br /> variances. Regarding the shared parking agreement, the request is <br /> acceptable due to the fact that the agreement is exclusively between <br /> the apartment/hotel and hotel uses which are mostly transient uses. <br /> With respect to the request to extend the time period to obtain a <br /> building permit for an additional 48-months, staff has no objection to <br /> this request. It is important to note that the 90 apartment/hotels are <br /> • subject to the 5% residency rule under the City Code. Simply put, <br /> residency is restricted on a continuing basis to no more than 6 months <br /> for 86 of 90 apartment/hotel units. <br /> Staff has reviewed the site plan application and is submitting this <br /> application with conditions for your consideration. <br /> REASONS: <br /> . The Applicant is seeking approval of a site plan for two 56-story <br /> towers consisting of 431 residential condominiums, 60 hotel units and <br /> 90 apartment-hotel units and 1,228,435 square feet of floor area ratio <br /> (FAR). <br /> The Applicant is requesting the utilization and._assignment of public <br /> TDRs in the amount of 283,485 square feet of FAR and 119 dwelling <br /> units. An adjustment to be made for a decrease of 283,485 square <br /> feet of FAR and 120 dwelling units from the City's TDR Bank.The total <br /> TDRs contribution, if approved, is$35,435,625. <br /> The Applicant is also proposing FAR bonus to increase FAR and <br /> density to the project. If approved, the FAR Bonus is$12,223,872.The <br /> Applicant is proposing the Design Flexibility which if approved, is <br /> $1,000,000.00, and the Applicant is contributing to the Art in Public <br /> Places for an amount not to exceed $500,000., the Applicant reserve <br /> the right to come back with an Artwork piece in the near future.
