ORDINANCE NO. 2015- y'12, AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING SECTION 156-2 OF THE CODE OF ORDINANCES OF SUNNY ISLES BEACH, ENTITLED "FEES AND MISCELLANEOUS" TO PROVIDE FOR PERMIT FEES FOR LANE AND BEACH ACCESS CLOSURES; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 156-2 of the City Code of Ordinances provides the City Manager or his designee with the authority to annually review the Building Department Fee Schedule and make recommendations to the City Commission; and WHEREAS, from time to time; the City is asked to close a lane of traffic or a Beach Access to facilitate construction. WHEREAS, the City Commission wishes to amend the permit fee schedule set forth in Section 156-2 of the City Code to require an Applicant who intends to close a beach access or a lane of traffic to obtain a permit from the City and pay a required fee. NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part by this Ordinance upon adoption hereof Section 2. Amendment. Section 156-2 of the City Code is amended to read as follows: § 156-2. Annual review. The City Manager and/or his designee are hereby directed to annually review the Building Department Fee Schedule to determine if an adjustment to the fee schedule should be recommended to the City commission.
