ECT is a leader in the environmental industry, as evidenced by the fact that the <br /> a company is listed as one of the top 200 environmental companies in the United States (Engineering <br /> News Record, 2011)and one of the 100 fastest growing companies in Florida. <br /> ECT's staff members have successfully provided civil/environmental engineering services for more than <br /> 22,000 projects throughout the United States and worldwide to a variety of clients in the private and <br /> public sectors. More than 70 percent of these projects were conducted for repeat clients, clearly demon- <br /> strating ECT's commitment to the highest levels of quality, technical services, and client satisfaction. <br /> These projects include civil/environmental engineering services provided to South Florida Water Man- <br /> agement District (SFWMD) since 1995, and petroleum remediation services provided to the Florida De- <br /> D partment of Environmental Protection (FDEP) at numerous sites in South Florida and throughout the <br /> state under continuing contracts since 1993. Other examples include the completion of Phase I and II <br /> environmental site assessments (ESAs) at hundreds of sites throughout the state for the Trust for Public <br /> Land, FPL Energy, all five water management districts, and numerous local financial institutions and <br /> private corporations. <br /> Normally, it would take one week to implement service after receiving the notice to proceed. <br /> 1.2 PENDING, ONGOING, AND PAST LAWSUITS AND CLAIMS <br /> In 2006-2007, ECT participated in a marina rehabilitation/redesign project for the City of New Smyrna <br /> Beach, Florida. In 2010, an individual filed suit against the City, ECT, the design engineer and the con- <br /> struction company for injuries sustained when he fell while walking from the end of the boardwalk on top <br /> of the bulkhead. ECT contended that, on the date of the fall, ECT no longer had any responsibility for <br /> the area where the fall allegedly took place. In March 2011, this suit was settled in mediation with ECT <br /> agreeing to pay $10,000 of the $62,500 settlement. There was no admission of guilt on ECT's part; it <br /> was less expensive to settle than to continue litigation. <br /> ' ECT, through hired collection agencies, has been involved in a number of cases to recover fees owed to <br /> us.
