(ECT), participated in a marina rehabilitation project for the City of New Smyrna Beach, Florida. In 2010, an individual filed suit against the City, ECT, the design engineer, and the construction company for injuries sustained when he fell while walking from the end of the boardwalk on top of the bulkhead. ECT contended that, on the date of the fall, ECT no longer had any responsibility for the area where the fall allegedly took place. In March 2011, this suit was settled in mediation with ECT agreeing to pay $10,000 of the $62,500 settlement.
